FADE IN.

[Airport. Day. The following events take place quickly.]

[A SWAT Sniper Team (sniper and spotters) moves carefully along a railing.]

[Police cruisers race along the tarmac.]

[The sniper team takes position. As they do, the engines of a plane can be heard in the background.]

[An armored car, carrying heavily-armed SWAT personnel, swerves towards the action.]

[Reporters and cameramen clamour at a safe spot, while cops try to hold them back.]

[Two SWAT officers move carefully, behind a SWAT shield.]

[The sniper team watches.]

[The two SWAT officers run up to a private airplane, whose engines are readying for takeoff. One of them places a metallic rope along the front tyres, and backs away quickly.]

[A pissed Sebastian Stark and a detective walk up to the plane. Madeleine Poe walks behind them.]

DETECTIVE: [loudly over airplane's noise] The Feds say Amir Khan is their guy!

SEBASTIAN STARK: I want him off that plane now!

DETECTIVE: But you want him alive. If Khan won't communicate, we'll have to assume a defensive posture!

[The detective moves away. Stark looks at the plane in frustration. A FBI vehicle comes up. Special Agent Cade Berlinger exits the vehicle and walks up to Stark and Madeleine, a paper in his hand.]

CADE BERLINGER: What do you think you're doing, Stark?

SEBASTIAN STARK: My job!

CADE BERLINGER: [handing Stark the paper] The FBI's taking over this operation. That's a federal cease and desist order.

SEBASTIAN STARK: [crumpling it up] You guys serve one of these at Waco?

CADE BERLINGER: You tell your men to stand down and let that plane take off. You don't have the authority.

SEBASTIAN STARK: [vehemently] I've got thirty cops here who'll back up any call I make! How do you spell authority? [intense] I am not going to allow Amir Khan to leave this city.

[Berlinger's cell phone rings. He answers it.]

CADE BERLINGER: [into phone] Berlinger. [listens] Yes, I'm on the ground now. Situation's under control, sir. [walking away] But if you have a minute... [voice trailing off]

MADELEINE POE: [to Stark] What do we do now?

SEBASTIAN STARK: Think fast. That plane takes off... Casey's dead.

[He looks at the grounded aircraft.]


FLASH TO:

[Unknown location. Day. Handheld camera, grainy picture. Casey Woodland sits at the base of a table, his hands tied behind his back to a table-leg. He looks beat up and his shirt is messed up. He drops his head weakly.]


FLASH TO WHITE.


[Opening credits.]


CUT TO:

[Airport. Day. Berlinger and Madeleine talk on their cell phones on the tarmac. DA Jessica Devlin stands inside the building. Stark walks up to her.]

JESSICA DEVLIN: [getting off her cell phone] That was the US Attorney for the Central District. We need to cede jurisdiction.

SEBASTIAN STARK: Forget it.

JESSICA DEVLIN: I'm with you on this one, but our hands are tied.

SEBASTIAN STARK: You want plausible deniability? You just say I disobeyed a direct order, say I was off my meds.

JESSICA DEVLIN: Sebastian...

SEBASTIAN STARK: There are lives at stake, Jess. Including Casey's. Think the Feds give a damn? It's on us.

[Berlinger enters.]

CADE BERLINGER: Madame District Attorney. Perhaps you can give Stark here a little primer on the Supremacy Clause.

JESSICA DEVLIN: [defiant] My office is in charge here, Agent Berlinger.

CADE BERLINGER: You're kidding me, right?

JESSICA DEVLIN: This is the culmination of a six-month investigation into the sale of explosives to Los Angeles gangs. It's a local matter. We're seeing it through.

[Stark shoots him a "screw-you" half-smile.]

CADE BERLINGER: [calmly] You have ten minutes to clear out. Then I bring in a Marine division and place anyone who interferes under arrest.

[He walks away. Stark checks his watch. It's a Klassik. The time shows 4:20.]


MERGE WITH:

[HPCU Office, Conference Room. Day. Stark testily looks up from his watch. Berlinger speaks while showing Jessica and Stark images on the screen.]

SUPERIMPOSE: 32 HOURS EARLIER

CADE BERLINGER: Amir Khan. Billionaire arms dealer. Dual Pakistani-American citizenship. Bureau's been after him

for years. Khan uses his import-export business as cover. He's smart, and he doesn't care about his body count. Chemical signatures  he sells have been found in explosions in Oslo, Tel Aviv and Edinburgh.

[Stark, in the meantime, has moved away, looking uninterested in what Berlinger says.]

CADE BERLINGER: Am I boring you, Stark?

SEBASTIAN STARK: I'm sorry, is there going to be a quiz?

CADE BERLINGER: Well, the point is, your surveillance of Khan is interfering with an ongoing federal investigation. As soon as we get enough to take this guy down on federal explosives charges, we're gonna move on him.

JESSICA DEVLIN: Khan's C-4 is responsible for a number of deaths in this city.

CADE BERLINGER: And if we nail him, he'll give us enough that we can shut down those in this country financing terror.

SEBASTIAN STARK: And how long is that gonna take? A year? Two years? Meanwhile, this guy's wreaking havoc here, now, today.

JESSICA DEVLIN: Which is why we will retain jurisdiction over Khan's activities here in LA

CADE BERLINGER: I appreciate your position, but when those activities raise national security implications...

SEBASTIAN STARK: How about LA security implications? That rap group blown up in their SUV last month. You think it was really a faulty fuel-injection? Khan has been unloading plastique and Taliban surplus weapons

to our street gangs.

JESSICA DEVLIN: Three car bombs in the past five months. Nine dead.

SEBASTIAN STARK: We're not bowing out so you guys can screw up somewhere down the line.

CADE BERLINGER: You've got a big mouth, Stark.

SEBASTIAN STARK: [right back at ya] And you're a brainless political hack.

JESSICA DEVLIN: All right. Look, we're both on the same side here. But I've got a mandate to reduce gang violence by stemming the flow of weapons to our streets. And stopping Khan, that tops the agenda. We're going forward.

[Stark gives Berlinger a smug look.]

CADE BERLINGER: Well, I want regular updates. You move... we're in the loop.

[He nods at Jessica for her confirmation. She gives him a half-nod. He leaves.]

JESSICA DEVLIN: [to Stark] All right, so how close are we to bringing off a sting operation?

SEBASTIAN STARK: [sighs] To nail Khan, I've gotta coordinate six agencies in LA County. I've gotta establish a site for the buy. I got to get Khan to bite. I mean, best guess, what, a week?

JESSICA DEVLIN: Forget it. Berlinger will make an ex parte motion, trying to federalize this. We have to go tomorrow.

SEBASTIAN STARK: [wheezes out a chuckle, mock-relieved] No pressure.

[Jessica makes an "I-give-up" motion.]

SEBASTIAN STARK: I'll make it happen.

[Satisfied, she leaves. Stark looks at the monitor, on which an image of Amir Khan is displayed.]


CUT TO:

[HPCU Office, Conference Room. Day. Stark speaks to two African-American undercover detectives, Ray Harkin and Willy Tarver. Both cops are dressed in street gang clothing, Tarver wearing a little extra bling along with his badge on a chain. The team is around.]

RAY HARKIN: [skeptical] You want to do this tonight?

SEBASTIAN STARK: We got the feds breathing down our necks.

WILLY TARVER: No way. There's a reason why we've been slow playing Khan. He'll get hinky if we push things up. He'll never sell us the explosives.

SEBASTIAN STARK: Look, when this started, I asked the Gang Unit for their two best detectives. I believe I got 'em. Now are you going to make this happen or what?

RAY HARKIN: [shrugs] There's no way.  Khan will smell a setup.

SEBASTIAN STARK: Fine. [snaps his fingers] You know what, let's just pack it in. Six months of work wasted. We'll spend the next six months informing next of kin.

[He starts to walk away.]

RAY HARKIN: [gives in] What's the plan?

SEBASTIAN STARK: [stops and turns around] Thank you. [motions for the team to speak]

CASEY WOODLAND: Khan's lawyer will argue entrapment. We need to establish a predisposition to sell us the C-4.

MARTIN ALLENDE: If the target balks committing a crime, we usually pull back, reset things, plan another buy.

RAINA TROY: But now we don't have that luxury. Push the guy if you have to. This is our only shot.

MADELEINE POE: You guys make the buy, we'll make it stick.

SEBASTIAN STARK: Where's our confidential informant?

ISAAC WRIGHT: [entering] Well, he's freaked, but he's on his way in.

[Isaac hands Stark a file.]

SEBASTIAN STARK: What do we know about this guy?

[Stark opens the file and looks at the picture of a smiling, unshaven Latino guy.]

MARTIN ALLENDE: Emilio Perez, small-time thief who was looking at three strikes for shoplifting. So he's working it off as a CI.

WILLY TARVER: We put him into play as Khan's handyman. Gives him access to his schedule, knowledge of people

around him.

SEBASTIAN STARK: Is he reliable?

RAY HARKIN: Till now, but he's definitely the nervous type.

MARTIN ALLENDE: Anyone would be nervous in his position. Emilio's been solid.

[The phone rings. Raina Troy answers it.]

MARTIN ALLENDE: [assuring] He'll be solid on the stand.

SEBASTIAN STARK: He'd better. His testimony about Khan's operations and movements are going to put this bastard away.

ISAAC WRIGHT: I'll baby-sit him, if need be.

WILLY TARVER: LAPD's got that covered.

RAINA TROY: [hanging up] Emilio Perez's lawyers just made an emergency motion for an early termination of his probation. Our confidential informant wants out.

SEBASTIAN STARK: [urgently] Raina, you're coming with me. Let's go, guys, [claps] come on!

[He walks out hurriedly.]

 

CUT TO:

[Stock footage of LA. Day.]


CUT TO:

[Courthouse, exterior. Day.]


CUT TO:

[Courtroom. Day. The Honorable Franklin C. Walker sits at the bench, as the bailiff places some documents in front of him. Emilio Perez sits at the Defense Table, while his lawyer stands and addresses the judge. Stark stands at the Prosecution table, while Raina sits.]

EMILIO'S LAWYER: Mr. Perez has provided information crucial to more than a dozen prosecutions over the past two years.

SEBASTIAN STARK: Which is why he's not rotting in Pelican Bay, Your Honor.

EMILIO'S LAWYER: The DA's unconscionable demands have monopolized his time and caused extreme emotional and mental distress.

[Emilio nods as she speaks.]

SEBASTIAN STARK: Oh, please...

EMILIO'S LAWYER: Mr. Perez has paid his debt, Your Honor. His parole should be terminated.

SEBASTIAN STARK: Benefit of the bargain, Judge. Mr. Perez enjoyed the benefit of staying out of jail. And now he must adhere to his end of the bargain as a confidential government informant. If Mr. Perez refuses to cooperate, the people demand that he be promptly incarcerated.

JUDGE WALKER: Mr. Perez may find the demands made on him onerous, but there's nothing coercive about his plea agreement.

EMILIO'S LAWYER: Your Honor, this...

JUDGE WALKER: [cutting her off] Motion denied.

SEBASTIAN STARK: Thank you, Your Honor.

[Emilio looks downcast at this ruling.]

SEBASTIAN STARK: [to Raina, whispering] You and Martin make sure this bozo gets on the bus.

RAINA TROY: [quietly] Okay.


CUT TO:

[HPCU Office. Day. Emilio paces along the balcony, while Martin Allende and Raina watch him.]

MARTIN ALLENDE: You need to calm down.

EMILIO PEREZ: [exasperated] Everything you asked, I did. I'm done. Terminado, okay?

RAINA TROY: You heard the judge, it doesn't work that way.

EMILIO PEREZ: I have a family!

MARTIN ALLENDE: We're not going to let anything happen to you.

RAINA TROY: You'll be off-site with us, ID'ing people from a remote location. A piece of cake.

EMILIO PEREZ: Yeah, maybe for you. Khan knows who I am. If he figures out I gave him up... [on the verge of tears]

RAINA TROY: We bring in Khan, you testify, you're done.

EMILIO PEREZ: Khan's people will find me.

[Martin looks at him sympathetically. Emilio sits down heavily on a chair.]

EMILIO PEREZ: I just want to have a life, okay? I want to live with my wife and daughter. Away from all this.

MARTIN ALLENDE: You will, but right now you need to finish what you started. Go home, play with your daughter. Lay low until the buy goes down tonight. Soon you can put all of this behind you.

[Emilio seems mollified and breathes a bit easier.]


CUT TO:

[HPCU Office. Night. The team (along with the two UCs) watches the undercover B&W footage shot by Harkin and Tarver. The screen shows Tarver and Harkin sitting with another guy, Kirk Bagley, in a bar booth. Timestamp shows "Dec 19 2006", time around 1:30 PM.]

KIRK BAGLEY: [on screen] A hundred keys of C-4, that's a lot of bang-bang. Would run you 900 G's.

WILLY TARVER: [on screen] Not a problem.

KIRK BAGLEY: [on screen] And you need this tonight, why? Blowing up Staples Center?

WILLY TARVER: [on screen] No, the Lakers are playing tonight.

RAY HARKIN: [on screen] Something came up.

KIRK BAGLEY: [on screen] Yeah, huh?

[Stark turns around and smiles at the UCs.]

WILLY TARVER: [on screen] Point is, we got the cash. Your boy wants to deal, we deal.

RAY HARKIN: [on screen] He doesn't, find another seller.

KIRK BAGLEY: [on screen, nods] I'll be in touch.

[Harkin and Tarver start to get up from the booth, Bagley behind them. Tarver turns around, facing down Bagley.]

RAY HARKIN: [on screen] Nothing personal, yo, but, uh, for the kind of jack we talkin' 'bout, we only deal with the big man here on out.

KIRK BAGLEY: [on screen, quietly] Yeah, yeah, yeah.

[Harkin hits the remote, pausing the video. Shark turns to him.]

CADE BERLINGER: Ten PM, roof of the parking garage at Foster and Crenshaw. [proud] Khan will make the drop himself.

SEBASTIAN STARK: Nice work. We're halfway home.

ISAAC WRIGHT: Alright, Khan's smart, but he's never been in the system. Which means he's arrogant. That can work for us. We'll have 360 degree visuals on you guys and you'll be miked up.

WILLY TARVER: [pointing to Isaac] He gonna be there?

SEBASTIAN STARK: Isaac has ten years of buy and busts. You want him there.

MADELEINE POE: Off-site surveillance is in place.

SEBASTIAN STARK: So, we got one shot at this, guys. Let's make it work.

[Stark and the team walks out. Harkin goes to collect his videotape. Isaac turns to Tarver.]

ISAAC WRIGHT: We got a problem?

WILLY TARVER: There is no "we."

ISAAC WRIGHT: You're gonna wanna dial back that attitude, Tarver.

[Harkin looks back, noticing the friction.]

WILLY TARVER: You plant evidence, embarrass the job, resign in disgrace. And you're talking to me about my attitude.

WILLY TARVER: So you're telling me if your partner was shot, you'd just let the guy who did it escape?

RAY HARKIN: [coming up] Hey, hey, hey. Isaac's cool, Willy.

[Tarver backs down.]

WILLY TARVER: I'll be in the car, Ray.

[He leaves.]

RAY HARKIN: [to Isaac] Willy's all right once you get to know him.

ISAAC WRIGHT: Alright, you just keep him out of my way.

[He leaves. Harkin nods and follows.]


CUT TO:

[Foster and Crenshaw, Parking Garage. Night. Tarver and Harkin stand up against their car, waiting impatiently.]


INTERCUT WITH:

[Surveillance room. Night. Madeleine, Stark, Martin and a tech (Lewis Slocombe) are inside, watching real-time footage of the UCs waiting. The time shows 22:06.]

MADELEINE POE: [looking at a text message] Isaac says he and Raina can't locate Emilio Perez.

SEBASTIAN STARK: I thought we had plain-clothes tracking him.

MADELEINE POE: He bolted. Went into a deli, ran out the back.

SEBASTIAN STARK: [frustrated] He's the only one who knows all the players. We shoulda put an ankle bracelet on that little weasel.

MARTIN ALLENDE: I'll have LAPD start a canvass.

SEBASTIAN STARK: You told me he was reliable. [annoyed] Damn it.

WILLY TARVER: [on radio] Our boy's arrived.

[The screen shows a car pulling up.]

SEBASTIAN STARK: Too late. Have to go without him.

[Outside, the car pulls up slowly in front of the UCs.]

SEBASTIAN STARK: Lewis, can you bring us in closer?

LEWIS SLOCOMBE: Zooming in.

[Lewis zooms the camera towards the driver. It's a young-looking guy (James Weyland), wearing a baseball cap.]

SEBASTIAN STARK: Who's this?

MARTIN ALLENDE: [checking pictures] We don't have a profile on this guy

SEBASTIAN STARK: I thought Khan was making the drop himself. This is not good.

MADELEINE POE: We can flip this kid and get him to finger Khan.

SEBASTIAN STARK: [exasperated] That assumes that Khan hired him directly. If he didn't, we don't have squat!

MARTIN ALLENDE: We could always pull the plug.

SEBASTIAN STARK: If the Feds convince a judge that we're interfering, we don't get a second chance. Ah, screw it!

[Stark grabs the radio.]

SEBASTIAN STARK: [into radio] It's a go, Willy. It's-a-go!

[Outside, the two UCs hear him. They watch James get out of the car carefully. He looks fearful at the sight of the two tough-looking UCs.]

JAMES WEYLAND: [timid] You Ray and Willy?

WILLY TARVER: Who's asking?

JAMES WEYLAND: Someone you know. Sent me.

RAY HARKIN: Sent you with what?

JAMES WEYLAND: [nervous] Stuff. It's in the trunk of my car.

WILLY TARVER: Then go get it.

JAMES WEYLAND: Um, I was told you would get it.

RAY HARKIN: [getting in James' face] Ehh, that's not how it works. We got some'n' for you, you have some'n' for us.

[James looks like he'll need fresh pants soon. He nods jerkily.]

JAMES WEYLAND: Yeah...

[He runs to the trunk.]

[Inside the surveillance room, Stark watches James open the trunk.]

SEBASTIAN STARK: Come on...

[Back outside, James starts to pull a heavy duffelbag outside the trunk. He drops it to the ground. The two UCs get a start, considering the possible volatile contents of the bag. They look a bit impatient as James slowly lugs the bag up to them.]

JAMES WEYLAND: You guys got the money, right?

[Harkin holds up his duffelbag. In slow motion, the bags exchange hands.]

[In the surveillance room, Stark gets on the radio.]

SEBASTIAN STARK: Take him.

[Outside, Tarver and Harkin draw their guns and point them at the terrified James, who goes down on his knees.]

WILLY TARVER/RAY HARKIN: Get down! Hands in the air!

[Other cops come up, weapons drawn. James is slammed onto the UCs' car hood. The other cops start to search him as Harkin holds him down.]  

RAY HARKIN: Right there. Got him?

[Tarver pulls the bag and opens it. He takes out one of its contents - a water balloon -  and stands up.]

[In the surveillance room...]

MADELEINE POE: What the hell?

[Outside...]

WILLY TARVER: Water balloons!

[He throws it to the ground forcefully, making it splatter water all around.]

[In the surveillance room...]

SEBASTIAN STARK: Khan knows we're on to him and [to Martin] I am betting your missing CI is the reason why!

[Martin closes his eyes. Stark glares at Emilio's picture.]


CUT TO:

[Stock footage of LA. Day.]


CUT TO:

[HPCU Office. Day. James Weyland sits nervously in the conference room, being grilled by Harkin, Tarver and Madeleine. Madeleine comes outside.]

SEBASTIAN STARK: You've been in there for seven hours with this guy. Tell me he's got something for us.

MADELEINE POE: [tired] Nothing beyond what we already know. James Weyland, 19, sophomore at Culver Community.

SEBASTIAN STARK: Ridiculous.

[The UCs also come outside.]

MADELEINE POE: Says some guy paid him 200 bucks to deliver a suitcase.

RAY HARKIN: And that guy got 200 to hire James.

ISAAC WRIGHT: Well, can the kid ID anybody?

WILLY TARVER: [wiping the sleep out of his eyes] Nope.

SEBASTIAN STARK: All right. Kick him. [to Martin] You know, this CI of yours is working both sides.

MARTIN ALLENDE: I'm sure there's a good reason.

SEBASTIAN STARK: You stand up for that two-faced lowlife one more time, you're going out the window.

MARTIN ALLENDE: Raina's down at the Division. She said the detectives that are staking out the Perez house just radioed in. The wife just got home.

SEBASTIAN STARK: Okay, you and Isaac, meet up with Raina and talk to the wife. Find Perez, bring him to me now.

[Harkin's cell phone beeps. He looks a text message. Martin and Isaac leave. Madeleine gets on the phone.]

MADELEINE POE: Hello?

WILLY TARVER: We'll ask around, see if anyone else Perez has worked with has a line on him.

RAY HARKIN: [holding up his cell phone] Gang Intelligence. Their sources report chatter about a major C-4 buy going down later today.

SEBASTIAN STARK: [suddenly understanding] That son of a bitch. Khan never intended to sell us the C-4! He knew that our buy was a set-up. He used it as a smokescreen! He draws all our resources to one place, and sets up the real buy someplace else! Okay, you guys hook up with Gang Intelligence, find out who's really planning to buy this stuff. All right?

[The UCs leave. Madeleine gets off the phone.]

MADELEINE POE: That was the FAA. Khan's cleared a flight pattern to Lucerne this afternoon.

SEBASTIAN STARK: LAX?

MADELEINE POE: And Burbank, and Van Nuys. He's got private jets at each.

SEBASTIAN STARK: Multiple flight patterns makes sense if you want to leave the country with a lot of cash and you're trying to avoid Customs.

MADELEINE POE: Cash you'd get from unloading C-4.

SEBASTIAN STARK: Okay, put all three airports on high alert.

MADELEINE POE: I'll take care of it.

[Stark's phone rings. He answers it.]

SEBASTIAN STARK: [into phone] Yeah. Speak. [listens] Great. Thanks!

[He hangs up.]

SEBASTIAN STARK: LAPD. They got a sighting on Khan.

MADELEINE POE: Where are you going?

SEBASTIAN STARK: [putting on his suit] I'm gonna take the direct approach. And you're going with me. Casey can handle the FAA. Fill him in on the way. Let's go.

[He leaves. Madeleine gets ready to follow.]


CUT TO:

[Stock footage of LA. Day.]


CUT TO:

[Outside The Century Plaza Hotel. Day. Stark and Madeleine stand outside waiting. Amir Khan and a burly bodyguard come out of the hotel, Khan speaking on his cell phone.]

AMIR KHAN: [cheerfully, into phone] Uh-huh. That was good.

[Stark and Madeleine approach and walk alongside them.]

SEBASTIAN STARK: Hope you had the blueberry pancakes. They're famous for 'em.

AMIR KHAN: I don't believe we have been introduced.

SEBASTIAN STARK: Sebastian Stark, the DA's Office.

AMIR KHAN: Stark, yes. I recall seeing you on TV.

SEBASTIAN STARK: I'm much better looking in person.

[They stop walking.]

AMIR KHAN: Something I can do for you?

SEBASTIAN STARK: [deadpan] For starters, you can stop killing people.

AMIR KHAN: I have no idea what you are talking about.

SEBASTIAN STARK: The RPG's, the Kalashnikovs, the Semtex, all that crap you dump on the streets...

[The burly bodyguard slowly and menacingly steps forward. Khan puts his arm up to stop him.]

SEBASTIAN STARK: [unfazed] ...it stops now.

AMIR KHAN: You must have me confused with someone else. Khan is a very popular name.

SEBASTIAN STARK: Not in my office.

AMIR KHAN: I work in import-exports. Precious gems, high-end ceramics. As for the allegation, I'm a...

SEBASTIAN STARK: ...murderer?

AMIR KHAN: [smiles] It was a pleasure meeting you, Mr. Stark. We must talk again.

SEBASTIAN STARK: Count on it.

[Khan starts to get into his limo.]

AMIR KHAN: [as he enters the limo] Perhaps over... blueberry pancakes?

[He gets inside. The bodyguard closes the door. Stark looks pleased with himself.]

MADELEINE POE: So much for the direct approach.

SEBASTIAN STARK: I thought it went pretty well.

[They leave.]


CUT TO:

[HPCU Office, Conference Room. Day. Raina, Martin and Isaac question Elena Perez, Emilio's wife.]

MARTIN ALLENDE: Where's Emilio?

ELENA PEREZ: [uneasily] I don't know. He left last night. He did not tell me where he was going.

RAINA TROY: He tell you when he was coming back?

ELENA PEREZ: [shakes her head] No.

ISAAC WRIGHT: Is this a regular thing with him, Elena?

ELENA PEREZ: Emilio is a good man. I don't ask where he goes.

MARTIN ALLENDE: Elena, you know what's at stake here. [sits down next to her] By not showing up to meet us last night, Emilio could go to jail. Is that what you want for your family? Is that what you want for your daughter? If you help us find Emilio, we'll work things out, I promise. Digame, Elena. (Tell me, Elena.)

ELENA PEREZ: [sobbing] They took her. They took my daughter.

ISAAC WRIGHT: Someone kidnapped your daughter?

ELENA PEREZ: I came back from the mercado two days ago. Emilio was crying. He said that they took Flora, and if he didn't do what they'd asked... [terrified] they'd kill her.

MARTIN ALLENDE: Did he know the people who took her?

ELENA PEREZ: No.

MARTIN ALLENDE: Okay, Elena, we will help you... [urgently] but you have to tell us where Emilio is.

ELENA PEREZ: [crying] I swear to God, I don't know.


CUT TO:

[HPCU Office, Stark's Office. Day. Stark looks at his notes. Martin, Raina and Isaac come inside.]

MARTIN ALLENDE: We got LAPD looking for Flora on the down low. If Khan thinks that Emilio went to the authorities, he might kill her.

SEBASTIAN STARK: Where are we on locating Emilio?

ISAAC WRIGHT: We put a pen register on Elena's home phone. She just threw a call into his cell. Cell location comes back to Downey.

MARTIN ALLENDE: Emilio mentioned a cousin in Downey. Javier, I think. Owns an auto body shop.

SEBASTIAN STARK: [to Isaac] You know your way around Downey?

[Before Isaac can answer, Tarver comes up from behind and answers.]

WILLY TARVER: I do.

SEBASTIAN STARK: We got a bead on Emilio Perez. Isaac'll fill you in. Where's your partner?

WILLY TARVER: Uh, Ray said he had something to take care of with Personnel. I'll have him meet us down there.

SEBASTIAN STARK: Right.

[Isaac and Tarver leave.]

SEBASTIAN STARK: Raina, Martin, you guys work the phones. Talk to people Emilio knows. See if you can help locate him.

MARTIN ALLENDE: Got it.

[They walk outside to their desks. Stark turns around and sees a tough-looking suit come inside, carrying a briefcase.]

SEBASTIAN STARK: Ah, Simon Bernhardt. To what do I owe the displeasure?

SIMON BERNHARDT: Always with the attitude. I represent Amir Khan.

SEBASTIAN STARK: My condolences.

[Raina and Martin note the exchange.]

SIMON BERNHARDT: My client is a respected businessman.

SEBASTIAN STARK: Your client is a cold-blooded killer with no respect for human life, but hey, you say "potayto..."

[Madeleine looks at them from her desk.]

SIMON BERNHARDT: I was hoping this would be amicable, but since you already dispensed with the civilities, let me say this - [threatening] if you ever accuse my client publicly again, for anything, I will sue you and this office for defamation and malicious prosecution.

SEBASTIAN STARK: Five hundred dollars an hour, and you still have a haircut that looks like it came with a bowl of soup. Go figure.

[Bernhardt shakes his head and leaves. Stark walks his little "Victory Walk".]

SEBASTIAN STARK: [exhales loudly in mock-fear] Sometimes I'm so good I scare myself.

MARTIN ALLENDE: How does mobilizing Khan's attorney help bring him down?

SEBASTIAN STARK: You know what? I should charge you guys tuition. I had to do something to draw Khan out, rattle his cage, and he went for it. Bernhardt has been repping LA's biggest gang figures since the Crips and the Bloods were kids squabbling over baseball cards.

RAINA TROY: He also represents Khan, which could explain how a blue blood like Khan got plugged in to the gang world.

MADELEINE POE: And if Bernhardt played matchmaker, a universe of potential buyers just got a whole lot smaller.

SEBASTIAN STARK: Precisely.

MADELEINE POE: I'm in awe.

SEBASTIAN STARK: You should be. Meet Casey at the courthouse. See if Bernhardt recently filed legal papers on behalf of any gang member with an explosives fetish.

[She prepares to leave.]

SEBASTIAN STARK: [teasing] While we're young?

[Madeleine hurries up.]


CUT TO:

[Prison, Outside Interview Room 3. Day. Tarver and Isaac stand outside the interrogation room. Emilio sits agitatedly inside.]

WILLY TARVER: [sounding bored] I just left Ray another message. He's probably grabbing a piece of tail.

ISAAC WRIGHT: Yeah, well, lucky for us, Emilio didn't put up a fight.

WILLY TARVER: [awkwardly] Listen, about yesterday...

ISAAC WRIGHT: Forget it, it's done.

WILLY TARVER: Nuh-uh. I was out of line. What happened with your partner... you did what you had to do.

[Stark enters, all set to bite Emilio's head clean off.]

SEBASTIAN STARK: Where is he?

ISAAC WRIGHT: Interview Three.

[Stark strides angrily towards the room, followed by Isaac and Tarver. Safe to assume, "Shark Mode" can be expected.]


CUT TO:

[Prison, Interview Room 3. Stark menacingly hovers menacingly over Emilio.]

SEBASTIAN STARK: Missed you last night, Emilio. Heard you had a pressing obligation in Downey.

EMILIO PEREZ: [nervous] Sorry, I was...

SEBASTIAN STARK: Shut up! We know you're working for Khan.

EMILIO PEREZ: That's not true.

SEBASTIAN STARK: [leaning towards Emilio] And we know about your daughter. You want to see her alive again, you come clean right now. [enunciating] Everything!

[Emilio says nothing. Stark jerks his head to Isaac to do the talking. Isaac comes up behind Emilio.]

ISAAC WRIGHT: Don't make him ask again.

EMILIO PEREZ: [quietly to Stark] Can we talk alone?

SEBASTIAN STARK: No. How long have you been feeding us false information?

EMILIO PEREZ: Three days.

[Stark, Isaac and Tarver exchange looks.]

SEBASTIAN STARK: What did you tell Khan about our operation?

EMILIO PEREZ: [angry] Everything! He has my daughter, okay?

SEBASTIAN STARK: When was your daughter taken?

EMILIO PEREZ: What's the difference? What counts is that they have her!

ISAAC WRIGHT: Look at me, Emilio.

[Emilio turns around.]

ISAAC WRIGHT: We wanna find Flora, but for that to happen, you can't lie to us anymore! You got to tell us everything! You can start by telling us who did the kidnapping!

[Emilio moves around slowly in his seat. Suddenly, he lashes out his hand, pointing towards Tarver.]

EMILIO PEREZ: His partner! Ray Harkin! Ray took her! He's a bad cop!

[Enraged, Tarver advances towards Emilio.]

WILLY TARVER: Lying son of a bitch!

[Isaac restrains Tarver.]

SEBASTIAN STARK: Get him out of here!

EMILIO PEREZ: He's a bad cop!

WILLY TARVER: I'll kill you.

SEBASTIAN STARK: Get him out!

[Isaac takes him near the door.]

ISAAC WRIGHT: [gently to Tarver] C'mon. Calm down.

EMILIO PEREZ: His partner is a bad cop. [jumping up from his seat] I swear to God. I swear to God, Ray took her. He made me do this. He works for Khan!

SEBASTIAN STARK: How long have you known this?

EMILIO PEREZ: Since Ray came and took Flora.

SEBASTIAN STARK: [looking him in the eye] You tell me the truth. Who's buying that C-4?

EMILIO PEREZ: They don't tell me nothing. But I know Khan has an apartment on Normandy and Wilshire. The day Flora was taken, I followed Ray. He went inside an apartment and came out with Khan. I told him to give me back my daughter or I'll go to the police. But Ray said he'd slit Flora's throat if I talked to anyone.

[Emilio looks at him, pleading. Stark looks behind and then back at Emilio.]

SEBASTIAN STARK: [reassuring] We'll get her back.

[Stark gets up and walks outside. Emilio looks distraught.]


CUT TO:

[Prison, Outside Interview Room 3. Day. Tarver paces up and down to calm himself. Isaac stands aside. Stark walks up to them.]

SEBASTIAN STARK: [to Tarver] Where's your partner?

WILLY TARVER: You can't believe anything that piece of crap Perez says. He'd throw his own mama under the bus to save his ass.

SEBASTIAN STARK: [harsh] Willy, where is Ray?

WILLY TARVER: I don't know, all right? He's not answering his cell.

SEBASTIAN STARK: Perez says they're holding his kid at Normandy and Wilshire. [getting on his cell phone] I'm calling in SWAT. Let's hit it.

[He walks away, followed by Isaac and Tarver.]


CUT TO:

[Stock footage of LA. Day.]


CUT TO:

[Normandy and Wilshire, outside apartment. Day. A SWAT team moves stealthily, H&K MP5s at the ready, followed by Isaac and Tarver (wearing bullet-proof vests). Two SWAT officers force open a door and hold it open so the others can move in. Isaac and Tarver follow.]


CUT TO:

[Normandy and Wilshire, inside apartment. Day. The SWAT team bursts inside. The place looks like a chem lab, with chemicals and bomb-making equipment on plastic-covered tables. The SWAT team moves around, looking for suspects. They find none.]

SWAT OFFICER #1: Clear!

SWAT OFFICER #2: [descending the stairs] Clear upstairs!

[Tarver and Isaac holster their sidearms and look at the chemicals.]

ISAAC WRIGHT: Citric acid, acetone. Detonators. This place is a C-4 lab.

WILLY TARVER: Khan wasn't just smuggling explosives, he was making 'em!

[Isaac opens a duffelbag and sees it's empty.]

ISAAC WRIGHT: The C-4's gone. He either moved the stuff or the buy already went down.

[Two SWAT officers notice something on the ground, covered by a large blanket. One of them pulls the blanket off, exposing a corpse lying face-down.]

SWAT OFFICER #1: We've got a body here.

[Isaac and Tarver approach the body.]

ISAAC WRIGHT: [looking at the body] Shot once in the back.

[He turns the body over. It's Ray Harkin.]

WILLY TARVER: Ray!

[Tarver looks grief-stricken, looking at the body of his partner.]

WILLY TARVER: [through clenched teeth] Perez. That son of a bitch set Ray up! [sighs]

[Isaac places his arm supportively on Tarver's shoulder.]

ISAAC WRIGHT: All right, Willy?

Tarver pushes it aside and strides outside in rage.]

ISAAC WRIGHT: [calling after him] Willy... Willy!

[Tarver shoves the door aside brusquely as he goes. Isaac checks on Harkin's body. He opens his jacket, to uncover a bomb, with the timer at 00:09. A red LED starts blinking, signaling an imminent countdown and explosion.]

ISAAC WRIGHT: [loudly] Bomb! Bomb!

[He jumps up and starts running to the door, motioning to the SWAT officers to do the same. They start running as well, shouting as they move. The timer counts down 4... 3... 2...]

[Outside, the SWAT team scramble out the door. Isaac, followed by two SWAT officers, just about clears the door, when the bomb explodes. He just manages to jump out of the reach of the fireball. The other two SWAT officers are not as fortunate, though, as the fireball engulfs them. In slow-motion, they fall to the ground, as the apartment burns.]

 

HARD CUT TO:

[HPCU Office. Day. Stark, Raina, Isaac, Martin and Tarver are present. Stark looks somber as Raina gets off the phone.]

RAINA TROY: One dead, four injured.

[Isaac sits there, shaken up and bruised.]

MARTIN ALLENDE: Bomb Squad says it was an IED hooked up to a time delay. Remotely detonated.

WILLY TARVER: Perez... sent us there. He knew the place was booby-trapped!

SEBASTIAN STARK: If that's true, I'll stick the needle in his arm myself. What's his ETA?

MARTIN ALLENDE: Sheriff's Department's bringing him down from County Lock-up right now.

WILLY TARVER: I'll talk to him when he gets here.

SEBASTIAN STARK: No. The only person you're talking to is a grief counselor.

WILLY TARVER: [arguing] Ray was my damn partner.

SEBASTIAN STARK: You're gonna continue working on this case under one condition, you follow orders. Order number one: you steer clear of Perez. [to Raina] Now what's the deal with this apartment?

RAINA TROY: Rented in cash under a dead-end alias. Explosion destroyed any useful forensics.

SEBASTIAN STARK: [frustrated] Okay, so to summarize, our case against Khan still sucks!

MARTIN ALLENDE: [getting off the phone] FBI Agent Berlinger... again. He wants to know what we got.

SEBASTIAN STARK:  Tell him I'm still in court.

[Madeleine and Casey enter.]

MADELEINE POE: Good news.

SEBASTIAN STARK: [smirks] You must be in the wrong office.

CASEY WOODLAND: White supremacist gang leader named Jake Forman was convicted of explosives possession three years ago. Got out last summer.

MADELEINE POE: His attorney? Simon Bernhardt. Forman fits the exact profile of someone itching to get their hands on C-4.

SEBASTIAN STARK: [grateful] Who says prayer doesn't work? Madeleine, you and I are going judge shopping. We're gonna get a wiretap on this guy Forman. Casey, the motions clerk at the federal courthouse gave me a heads-up. The Feds are seeking a cease and desist order. They want to kill our investigation and go after Khan themselves.

CASEY WOODLAND: I'll keep tabs.

SEBASTIAN STARK: [to Tarver] Now, check in with the Bomb Squad. See what they got on this guy Forman. Okay? [to everyone] Guys. We gotta get the rest of the C-4 off the streets before more people die and we gotta grab Khan before he leaves the country. Let's move.

[He starts to walk out. Tarver comes up to him.]

WILLY TARVER: You got a minute?

SEBASTIAN STARK: Thirty seconds.

WILLY TARVER: Bomb Squad's territorial. Now, I go askin' questions about Forman, they're gonna demand to be brought in on the investigation. Unless I can get a DDA with me to pull rank.

SEBASTIAN STARK: [agreeing] Casey, I need you backing Tarver with the Bomb Squad.

CASEY WOODLAND: Got it.


CUT TO:

[DA's Office, Elevators. Day. Casey hits the elevator button, while Tarver speaks on his cell phone.]

WILLY TARVER: [into phone, mumbling] Right.

[He hangs up and speaks to Casey.]

WILLY TARVER: My guy down at the Bomb Squad says they don't even have a file on Forman.

CASEY WOODLAND: That's weird. He did time for possession. And C-4 isn't exactly a starter kit for explosives.

WILLY TARVER: Trust me. Bomb Squad's a black hole. Bunch of cowboys. No one keeps records.

CASEY WOODLAND: Well, maybe we should head over there anyway. See what we can find out.

WILLY TARVER: Waste of time. I know a guy who may have intel on Forman. He works down at the ADL. He's got a file on every racist twitch on the West Coast. You up for a ride?

[The elevator dings. The door opens.]

CASEY WOODLAND: Let's go.

[They step into the elevator.]


CUT TO:

[HPCU Office. Night. Raina walks up to Isaac, who sits at his desk, in the darkened office, listening to the wiretap.]

RAINA TROY: Anything off the wiretap?

ISAAC WRIGHT: Nothing we can use. You know, Sebastian got us a wiretap in twenty minutes. Guy's a magician.

RAINA TROY: I have a front row seat. I still don't know how he does it. [puts a paper bag in front of him] Got you a burger.

ISAAC WRIGHT: [appreciative, keeps bag aside] Mm, thanks. 'Preciate it.

RAINA TROY: It's just a burger.

[He smiles at her. Then, he holds up his hand, having just heard something off the wire. He puts down the headphones and hits a few keys on the keyboard.]

ISAAC WRIGHT: Check this out.

[On the monitor, a map is displayed. A graphic equalizer is displayed as a voice is heard.]

JAKE FORMAN: [from wire] Yeah, gonna rent a place in Mobley Heights. Getting screwed on the price. Told the guy I like a little sweet talk first.

[Isaac hits a few keys to kill the sound.]

ISAAC WRIGHT: Now, Mobley Heights is just past Palmdale. There's lots of black folks. Not exactly a paradise for a white supremacist.

RAINA TROY: I worked a case down there last year. Tons of storage facilities.

ISAAC WRIGHT: All right, so he's not living there. He's using it for storage.

RAINA TROY: I'll call for a search warrant.

[She leaves.]


CUT TO:

[HPCU Office, Conference Room. Day. Jake Forman sits, arms folded military-style (hands under the armpits). Looks like many white supremacists - long hair, French beard, tattoos, cocky attitude (especially to two black interrogators).]

ISAAC WRIGHT: What were you planning on doing with all the C-4 we found in your storage locker, Jake?

JAKE FORMAN: [uninterested] I'm in construction. Ran out of blasting caps.

RAINA TROY: Except C-4's illegal. Blasting caps aren't.

JAKE FORMAN: Guess you're gonna have to fine me.

RAINA TROY: We're gonna do a lot more than that.

[He looks at Raina and Isaac with disdain.]

JAKE FORMAN: [sarcastically] Nice to see affirmative action is alive and well in LA County.

[Isaac, not a fan of racists, leans close to him menacingly.]

ISAAC WRIGHT: Another crack like that, you'll be spitting teeth.

JAKE FORMAN: [unfazed, to Raina] How about calling off your Doberman?

RAINA TROY: Sorry, he's not trained. So pay attention.

[She slides a picture of Ray Harkin (in police uniform) up to Forman.]

RAINA TROY: Dead cop. Death sentence.

JAKE FORMAN: [suddenly serious] Whoa, what are you trying to pin on me here?

RAINA TROY: Capital murder.

JAKE FORMAN: What?

[She slides a picture of the SWAT officer, who died in the explosion, towards Forman.]

RAINA TROY: Two counts.

JAKE FORMAN: Wait, hold on, I didn't kill nobody.

RAINA TROY: The C-4 you bought has the same chemical signature as the explosives sold by Amir Khan. A chemical signature is just like a fingerprint.

ISAAC WRIGHT: Which ties you to Khan's stash house where two cops died.

JAKE FORMAN: You got the wrong guy. I don't anything about any dead cops.

RAINA TROY: Even if you didn't fire the gun or light the fuse, we've got you on conspiracy and felony murder.

JAKE FORMAN: No way!

RAINA TROY: [taunting] Any more affirmative action jokes?

JAKE FORMAN: [gives in] Look, all I did was buy the stuff.

ISAAC WRIGHT: From Khan?

JAKE FORMAN: Who knows? I posted an ad on this Internet forum, looking for C-4. Someone referred me to an 800 number. Talked to this guy a few times. Wired the money. Dude mailed me the key to a locker at Union Station.

ISAAC WRIGHT: You lie to us, your racist ass gets rung up for murder.

JAKE FORMAN: I'm not lying! I never met this guy Khan. I was never in any stash house. And I didn't kill nobody!

[Raina looks at him.]


CUT TO:

[DA's Office, Hallway/HPCU Office. Day. Stark and Jessica walk along the hallway.]

JESSICA DEVLIN: So, how things play out with Forman?

SEBASTIAN STARK: Well, the good news is we got the C-4 he bought off the streets.

JESSICA DEVLIN: What was he going to do with it?

SEBASTIAN STARK: Probably clearing ground for a new synagogue.

JESSICA DEVLIN: All right, here's the $64,000 question: Does he get us to Khan?

SEBASTIAN STARK: Nno.

JESSICA DEVLIN: [sighing] So where does that leave our case?

SEBASTIAN STARK: In the dumper. And Berlinger moved to enjoin our investigation.

JESSICA DEVLIN: [laughs] So what do we do now?

SEBASTIAN STARK: Drink heavily.

JESSICA DEVLIN: Mmm.

[They reach the HPCU Office. Madeleine walks up to them.]

MADELEINE POE: We just got word. Khan's on his Gulfstream at the Van Nuys Airport.

JESSICA DEVLIN: He's unloaded his C-4, got his money, now he's looking to put as much distance between himself and California as possible.

[Stark looks towards the conference room, where Raina and Martin watch a distraught Emilio Perez.]

SEBASTIAN STARK: That plane takes off, the CI's little girl is history. [to Madeleine] Call the Control Tower, tell them to keep Khan grounded.

MADELEINE POE: Already done.

SEBASTIAN STARK: You coming?

JESSICA DEVLIN: I'll meet you there. [leaves]

SEBASTIAN STARK: Good.

[He walks off.]

[In the conference room...]

MARTIN ALLENDE: [angry] I vouched for you, Emilio. And all you've done is lie.

EMILIO PEREZ: My daughter's life is at stake. And I'm telling the truth now. Harkin told me what to do. He took Flora. He works for Khan.

RAINA TROY: [miffed] Ray Harkin is dead.

EMILIO PEREZ: [stunned] What?

RAINA TROY: Yeah, the stash house that you sent us to? A bomb went off. Another cop is dead, too, and we're holding you accountable.

EMILIO PEREZ: [horrified] No, no. I didn't know anything about a bomb.

MARTIN ALLENDE: It's over! Do you understand?

EMILIO PEREZ: [sincerely] I'm sorry. Tarver gave me no choice.

RAINA TROY: [skeptically] Oh, so now Tarver's pulling the strings?

EMILIO PEREZ: Tarver took Flora. You must listen to me, please!

MARTIN ALLENDE: No, we're done listening to you, Emilio. First you put it on Harkin. Now you're putting it on Tarver. You've done nothing but lie.

EMILIO PEREZ: No. You can check, okay? I saw, I saw Khan give Tarver money. And Tarver gave me this.

[With trembling hand, he pulls out a Polaroid from his wallet. He looks at the Polaroid in fear and then slides it towards them. It's a picture of Flora Perez, holding up a copy of the Los Angeles Chronicle, to provide proof of "date of kidnap."]

EMILIO PEREZ: [sadly] I had to lie to you.

[Martin and Raina seem to believe him now.]

MARTIN ALLENDE: If you were doing Tarver's bidding, why'd you take us to court, try to get out of this?

EMILIO PEREZ: I thought if I no longer worked for you, then I'd be useless to Khan. And he would let Flora go. But it didn't work. [choking] And now Tarver is going to kill my little baby.

[Martin and Raina exchange worried looks.]


CUT TO:

[Van Nuys Airport, Tarmac. Day. Khan's plane stands on the tarmac. Police cruisers stand around it. Stark and Madeleine push through the assembly of reporters, who clamour to interview him.]

SEBASTIAN STARK: Come on, let us through, come on. Get the media back.

[His cell phone rings. He answers it.]

SEBASTIAN STARK: [into phone] Speak!

[He puts his finger in the other ear to block out the noise of the plane engines, as he listens.]

SEBASTIAN STARK: [into phone] Right.

[He hangs up.]

SEBASTIAN STARK: [to Madeleine] That was Raina. Perez is putting it on Tarver. They ran Tarver's accounts. Guy's worth two and a half mil. [suddenly realizing] Casey.

[Madeleine seems concerned. Stark gets on his cell phone and dials Casey's number. It only rings.]

SEBASTIAN STARK: [worried] Come on, man, answer the phone.


CUT TO:

[Unknown location. Day. Casey can't answer the phone buzzing away in his pocket right now. His arms are tied behind his back to a table-leg. His feet are also bound. Looks like he's taken a beating as well from Tarver. Tied to an adjacent table-leg is Flora Perez, tied in a similar manner, with duct tape over her mouth. Close by, Tarver walks restlessly, gun in hand. Impatiently, he looks at his watch. He passes by Casey and Flora, who exchange glances.]


HARD CUT TO:

[Unknown location. Day. Handheld camera, grainy picture. Tarver's hand grabs a handful of Casey's hair and pulls his head back and aims the gun at his temple.]

CADE BERLINGER: [vo] You have ten minutes to clear out.


CUT TO:

[Van Nuys, Airport building. Day. We're back to the point where we left off in the beginning. Berlinger speaks to Stark and Jessica.]

CADE BERLINGER: Then I bring in a Marine division and place anyone who interferes under arrest. How's that?

[He moves away. Stark looks at his watch and sighs. He and Jessica exchange a glance. Madeleine approaches.]

SEBASTIAN STARK: Yeah.

MADELEINE POE: Casey's still not answering.

SEBASTIAN STARK: Keep trying.

[She moves away, trying Casey's number.]

JESSICA DEVLIN: We don't know for sure anything's happened to him.

SEBASTIAN STARK: Look, Tarver killed his own partner, Jess. He tried to blow us up. Smart money says he's holding Casey and Flora hostage somewhere at Khan's behest.

[Jessica's cell phone rings. She looks at the text message.]

JESSICA DEVLIN: Control Tower says Khan still won't answer his radio.

SEBASTIAN STARK: And why should he? What do we got on him? Only one who can tie him to anything is the dirty cop we can't find.

JESSICA DEVLIN: I understand him grabbing the girl. But why Casey?

SEBASTIAN STARK: Insurance. But when that plane takes off, hostages become witnesses.

JESSICA DEVLIN: And expendable.

SEBASTIAN STARK: So we gotta figure out a way to get Khan to call Tarver off.

JESSICA DEVLIN: And arrest Khan before the Feds arrest us. All in the next... [checks her watch] nine minutes.

SEBASTIAN STARK: [inhales, smiles] Piece of cake.

[He walks away.]


CUT TO:

[Unknown location. Day. Flora sits quietly. Tarver is on his cell phone, pacing agitatedly. Casey looks at him and then at Flora.]

CASEY WOODLAND: Hi. I'm Casey. You Flora?

[Flora nods tearfully.]

CASEY WOODLAND: I'm friends with your daddy. I know this is really scary, but I promise everything's going

to be okay.

[Flora nods, calming down. Tarver walks past them.]

WILLY TARVER: [into phone] That money was supposed to be wired two hours ago. Call me as soon as the bank receives it. [hangs up]

CASEY WOODLAND: [taunting] Waiting for the money Khan was supposed to pay you?

WILLY TARVER: [sharply] Is paying me.

CASEY WOODLAND: You can use it to hire a really good lawyer. You killed two cops. You're going down.

WILLY TARVER: Actually, I'm going up. I'm leaving the country on Khan's plane tonight. This time tomorrow, I'll be in Marbella drinking a mojito.

CASEY WOODLAND: Just one problem. Khan's leaving the country today. He's not taking you. And he's not paying you.

WILLY TARVER: [irritably] Shut up!

CASEY WOODLAND: He cleared a flight pattern to Lucerne for this afternoon. He's hanging you out to dry. If you don't believe me, call him.

WILLY TARVER: Your boys are listening in to Khan's calls! You trying to play me!

CASEY WOODLAND: You worked us for six months. Fed us false information about Khan's movements, the phony buy...

WILLY TARVER: [proudly] I got damn well paid for it, too.

CASEY WOODLAND: How much you get paid for killing your partner?

WILLY TARVER: [almost regretfully] Ray got curious, started sniffing around. I didn't have a choice.

CASEY WOODLAND: Look, you got what you needed from Emilio, let the little girl go.

[Tarver has had just about enough of Casey's lip. He draws his gun and walks up menacingly towards him.]

WILLY TARVER: It's been a real nice conversation, but it's over now. Open your mouth again... [noisily cocks his gun] I'll put a bullet in it.

[He aims the gun at Casey's forehead. Casey closes his eyes tightly and shuts up.]


CUT TO:

[Airport building. Day. Berlinger approaches Stark and Jessica.]

CADE BERLINGER: Time's up. What's it gonna be?

SEBASTIAN STARK: I just have one question. Why does the federal government want to give a pass to a guy who's implicated in two cop killings?

CADE BERLINGER: You don't have the evidence to tie Khan to anything, let alone murder. We know how to build a case. And we know how to make it stick.

JESSICA DEVLIN: We have witnesses who'll flip on Khan. He'll be convicted.

CADE BERLINGER: That's not going to work for us.

SEBASTIAN STARK: Why the hell not?

CADE BERLINGER: [starts to walk off] I'm not having this discussion.

SEBASTIAN STARK: [understands] You don't want him taken in, do ya?

[Berlinger stops walking and turns.]

SEBASTIAN STARK: Do ya?

CADE BERLINGER: Mr. Khan is a very important asset.

[Stark looks incredulously at Jessica. She raises her eyebrows and walks up to Berlinger.]

JESSICA DEVLIN: Which means what?

CADE BERLINGER: He's led us to Al Qaeda strongholds...

SEBASTIAN STARK: [sighing] Ohh...

CADE BERLINGER: Taliban operatives. We need him in the field.

SEBASTIAN STARK: You lying... you... You-you were never building a case against Khan. You were just riding herd on us, weren't you? Keepin' tabs, making sure - hoping! - we would fail.

CADE BERLINGER: The Bureau runs things on a need-to-know basis. Now you need to know.

SEBASTIAN STARK: Well, here's what you need to know. I got a DDA and an eight-year-old girl whose lives hang

in the balance. I am not signing two death warrants so you can protect some spy.

CADE BERLINGER: The War on Terror is bigger than any two lives, Stark. Listen, you got Khan's C-4 off your streets. Take a victory lap. Walk away.

[Stark chuckles evilly. He looks outside at the reporters, clicking away and holding up their boom-mikes.]

SEBASTIAN STARK: I'm gonna take a walk all right. Watch this.

[He strides purposefully past Berlinger.]

CADE BERLINGER: Stark.

[A harried-looking Madeleine comes up to Jessica.]

CADE BERLINGER: [following Stark] Stark!

MADELEINE POE: What's he doing?

JESSICA DEVLIN: I don't know.

[They both look out the window at the plane.]


CUT TO:

[Van Nuys Airport, Tarmac. Day. A cop stands behind his cruiser, aiming his gun at the plane. The automatic sliding doors open and Stark walks full-pace towards the aircraft. Berlinger and other FBI agents follow him.]

CADE BERLINGER: Stark, get back here.

SEBASTIAN STARK: Shoot me!

CADE BERLINGER: Stark!

[Stark walks, with his hands in the air, towards the plane. The reporters notice him. Berlinger instructs the other FBI agents to hold back. Stark continues walking towards the plane.]

CADE BERLINGER: Hang on here. We've got press here.

[Stark approaches the plane, hands in the air. He looks towards the sniper team in their position and waves to them. He walks towards the door.]

[Jessica and Madeleine watch anxiously.]

[Stark waves towards the plane.]

SEBASTIAN STARK: [loudly over the engine noise] Amir, this is Sebastian Stark! If you talk to me, I give you my word my men will neither harm you nor arrest you! This thing can end right now! You can be in the air in five minutes!

[A suspenseful beat later, the airplane door opens slowly. The reporters react excitedly. Amir Khan emerges from inside the darkened plane. The sniper team takes aim. Stark stands, hands still raised. Khan looks around and slowly starts descending the steps towards Stark.]

AMIR KHAN: You are becoming quite a nuisance, Mr. Stark. But if this conversation will end our business...

SEBASTIAN STARK: [drops his hands] Here's the deal. You have a man on your payroll named Detective Willy Tarver. He's holding two people hostage. I want them released... unharmed. If you make this happen, I promise I will protect you from the US government.

AMIR KHAN: This is nonsense.

[He turns to get back in the plane.]

SEBASTIAN STARK: [yelling] I have evidence linking you  to the murder of two Los Angeles police officers!

AMIR KHAN: You are bluffing.

SEBASTIAN STARK: You see the press over there? I just gave them a statement to that effect!

AMIR KHAN: [still skeptical] Good for you.

SEBASTIAN STARK: ["Shark Mode"] Fine. Take off. Just know that the Feds are going to shoot you out of the sky the second this plane crosses into open waters.

AMIR KHAN: You gave me your word I would not be harmed.

SEBASTIAN STARK: I told you my men would not harm you. But my men are no longer in control.

[Khan takes a worried look towards where Berlinger and his agents stand, watching Stark. He sees their FBI uniforms. He swallows nervously.]

SEBASTIAN STARK: But I can offer you a way out! Or you can just take your chances in the friendly skies!

AMIR KHAN: [falls for it, nods] I'm listening.

[Khan walks up to Stark.]

SEBASTIAN STARK: [quietly] Release the hostages and confess to federal weapons violations. Now I will tell the press that I was wrong, that you had absolutely nothing to do with the dead cops. Once the feds don't have to fear bad PR, they rescind your death sentence.

AMIR KHAN: But I still go to jail.

SEBASTIAN STARK: A slap on the wrist. Beats a casket. [looks behind at the Feds] What's it gonna be?

AMIR KHAN: [beat] I lease a warehouse on Washington and Clover. There have been several break-ins recently. I cannot be sure what's in there.

SEBASTIAN STARK: [pulls out his cell phone] I'm turning on my voice recorder. I want you to repeat after me. "I, Amir Khan,..."

[Berlinger looks suspicious.]

SEBASTIAN STARK: "...have imported and manufactured plastic explosives in violation of Title 18 of the US Code." [holds up the cell phone] Speak.

AMIR KHAN: [into the cell phone] I, Amir Khan, have imported and manufactured...

[Berlinger, realizing that Stark has conned Khan into confessing, beckons the agents to follow him, as he walks quickly towards Stark.]

AMIR KHAN: ...plastic explosives in violation of Title 18 of the US Code.

CADE BERLINGER: [approaching] Stark.

SEBASTIAN STARK: [to Berlinger] Mr. Khan has just confessed to violation of federal explosives law. [holding up his cell phone] I have a recording of him doing so. He would now like to be taken into custody in your protection.

[He moves away and dials a number on the phone.]

SEBASTIAN STARK: [into phone] This is Stark. I need a SWAT team sent to the following address...


CUT TO:

[HPCU Office, Kitchen. Day. While Emilio paces around, Elena sits nervously at the table. Martin and Raina stand close by. Martin's cell phone rings. He answers it.]

MARTIN ALLENDE: [into phone] Martin. [listens] Okay.

[He hangs up.]

MARTIN ALLENDE: [to Raina, urgently] We may have a location for Detective Tarver.

EMILIO PEREZ: And Flora?

MARTIN ALLENDE: We hope so.

EMILIO PEREZ: I'm coming. [collects his coat]

RAINA TROY: We can't allow that.

EMILIO PEREZ: She's my daughter. I'm coming with you.

MARTIN ALLENDE: [nods] Let's go.

[He walks out.]


CUT TO:

[Washington and Clover, Outside Warehouse. Day. Isaac stands outside the warehouse as a SWAT vehicle pulls up. He readies his gun as the SWAT officers prepare to breach.]

[Inside the warehouse, Tarver is getting more and more agitated. Casey sits quietly.]

[Outside, on the other side, police cruisers have taken position, with cops waiting in case he were to exit through the back.]

[Outside, at the front door, a SWAT officer breaks the lock on the door.]

[Inside, Tarver hears it and looks behind.]

[The SWAT team enters stealthily.]

[Tarver shoves his gun into his pants and starts to untie Flora.]

CASEY WOODLAND: Take me instead.

WILLY TARVER: [warning] Shut up.

[The SWAT team climbs up the stairs, nearing Tarver. Flora screams.]

[Tarver runs away, carrying Flora, who screams again. The SWAT team come in.]

CASEY WOODLAND: Tarver just went out the back! He's got the girl!

[Outside, Tarver bursts through the back door, carrying Flora and his gun. He's moving right towards the cops.]

[Inside, Isaac unties Casey.]

[Outside, Tarver stops, noticing the cops.]

COP ON MEGAPHONE: C'mon, Tarver! Let her go!

[Flora manages to break free of Tarver's grip and runs.]

COP ON MEGAPHONE: Tarver, freeze! Put the gun down now!

[The SWAT team and cops keep their guns trained on Tarver. He drops his shoulders as if to surrender. Then suddenly, he opens fire towards them (suicide-by-cop). The cops return fire. In slow-motion, Flora runs, covering her ears. Martin. Raina, Emilio and Elena pull up in the car. Martin and Emilio jump out.]

EMILIO PEREZ: Elena, no! Stay in the car!

MARTIN ALLENDE: [to Raina] Stay down!

[Emilio runs towards Flora. In slow-motion, a cop grabs him. Tarver meanwhile keeps firing. He notices Emilio and fires. Emilio (who manages to escape the cop's grip) is shot in the leg, a few feet away from Flora. He drops to the ground in pain. Flora screams. The cops and Tarver continue firing at each other. Martin, seeing Flora exposed, starts to run towards her. Raina fearfully ducks in the car. Martin rushes past Tarver and grabs Flora. The cops keep firing at Tarver. Martin runs, with Flora in his arms, an expression of pain on his face. Finally, the cops manage to drop Tarver, who takes three in the chest. He falls. The first SWAT team runs towards them. Casey and Isaac follow them. Isaac comes over to look at Tarver, who lies dead on the ground. Flora runs alone towards her wounded father. He hugs her.]

[Raina slowly gets out of the car. She looks around and sees something, much to her horror. In slow-motion, she sees Martin slumped on the ground. She runs over to him and turns him over. He's unconscious.]

RAINA TROY: [screams] I need an ambulance!

[Casey looks towards her and sees Martin.]

CASEY WOODLAND: Martin!

[He runs towards them.]

RAINA TROY: I need an ambulance!

[Raina cries.]

CASEY WOODLAND: Martin.

[Casey checks Martin's vitals.]

RAINA TROY: [pleading] Casey.

[They crouch down next to Martin, waiting helplessly for someone to get an ambulance.]


CUT TO:

[Hospital. Night. A tired Stark leans against the wall, fighting the sleep in his eyes. He looks over at the rest of the team, in the waiting room.]

MADELEINE POE: Khan'll get five to ten, max.

CASEY WOODLAND: They'll stick him in Club Fed. Conjugal visits, work release, he'll be out in three.

SEBASTIAN STARK: That's three years he won't be dumping explosives on our streets.

[They stand quietly.]

RAINA TROY: [smiling] Martin always said he would be a cop if he had [chuckling sadly] fifty pounds and five more inches.

[Stark smiles. Madeleine and Casey laugh. Behind them, the surgeon comes up. The smiles fade as they look at him. He shakes his head slightly. Martin Allende didn't make it. Stark closes his eyes and drops his head. He acknowledges the surgeon, who leaves. Raina starts to cry. Madeleine has a look of disbelief on her face. She hugs Raina and can't control her tears any longer. She and Raina sob together. Casey sits, his face buried in his hands. Stark weakly sits next to him and sighs. He places his hand on Casey's shoulder and exhales sadly.]
