Scene: Gala Evening for LSP
Burton & Nick, dressed in business attire, sit at a round table with Lulu, Brian, Jake and James, Mary, and Amy Heckt, dressed in evening attire. Alvin is on the stage, telling a joke.
Alvin: And the bartender says, 'You know, we've got a drink named after you.' And, well, the grasshopper says, 'Really, a Larry Evans?' (The drummer does a rimshot-scattered titters) The grasshopper's name is Larry Evans. Now, with no further ado, I would like to introduce Mr. Burton Fallin, our Lifetime Achievement Award winner. Burton.
Applause and singing of “For he's a jolly good fellow…” Burton goes to the stage to accept the award.
Burton: Thank you. Please, thank you very much. The real heroes here tonight, the real achievers, are you people. For that, I thank you very much. I salute you. Keep up the good work. Thank you very much. (Applause)
Alvin: Congratulations. And tonight, Burton, I'm pleased to report that we have raised $79,000. The money will go to help maintain the high level of free legal service that we provide. Thank you. (Shakes hands with Burton)
Burton: Keep it up. Good. Thank you. (Returns to his seat)
Nick: Congrats. (Shakes Burton's hand)
Burton: Thanks.
Alvin: Amy Heckt came to us last year…
Mary: Wow! Lifetime Achievement.
Lulu: Burton, I put a bid on your antique law books.
Burton: How much, uh… how much did you bid?
Lulu: A little over a hundred dollars.
Burton: Hundred?
Lulu: Uh-huh.
Brian: Yeah, I told her it was too much.
Alvin: …I would like, Ladies and Gentlemen, to introduce Ms. Amy Heckt. (Applause as she takes the stage)
Lulu: Mrs. Gressler, it's so nice that you and Burton stayed in touch.
Mary: I'm living with him.
Lulu: Oh. (Nick is noticeably surprised) So many times in our line of work, we meet nice people and we never see them again.
Amy: (At the microphone) …speech, so here it is. (Clears her throat) A little over a year ago. I was a drug addict. I had a baby, Charlie, born addicted to cocaine. Social Services took him away right when he was born and I ended up back on the streets just a few days later doing terrible things for money. Terrible things. But, I don't know, I just couldn't stop thinking about my baby. So I heard about Legal Services and I got clean. A month ago, I got custody of my son, all thanks to these people and especially Mr. Masterson. (Applause) (To Alvin as he hands her the plaque) Thank you.
Alvin: Good job.
Amy: Thank you very much. (Hugs Alvin)
Back at the table.
Jake: Your story. It's amazing.
Amy: Thank you.
Waiter: Excuse me. Wine, sir?
Jake: (Covers his glass) No. (To Amy) My back is out. I'm taking Codeine.
Amy: Oh. (To waiter) Oh, no, thanks.
Jake: So, you grew up in Pittsburgh?
Amy: Yeah. I went to Keystone Oaks.
Jake: K-O? (Laughs) Get out! So did I.
Amy: Really? When?
Jake: Ah, Jeez. I graduated in '84.
Amy: '95. I would have… yeah, graduated.
Jake: So you had Mr. Polenko and Mr. McNeill?
Amy: No. I was taking Vo-Tech classes.
Jake: I took some of those. Metal Shop and Car Repair and Wood Shop.
Amy: You took those?
Jake: Well, my dad – he's in plumbing supplies. And he thought it might be smart if, after high school, I came and worked with him.
Amy: But, you didn't do that.
Jake: No, I didn't do that. No. I went to college and then I went on to law school.
Amy: See. That is what we're talking about. We can do these things.
Jake: Yes, we can. (Laughs)
Scene: Amy Heckt's apartment—next morning
Jake awakes to find himself in bed with Amy. The baby starts to cry. Amy wakes up.
Jake: Hi.
Amy groans and lights up a cigarette.
Jake: So, do you wanna go for a cup of coffee or something?
Amy: I can't. Baby.
She walks, naked, to the bathroom but doesn't close the door—looks in the mirror then dips into a small vial and takes a snort of cocaine while Jake watches.
Amy: You can come by again tonight – if you want.
Scene: Fallin & Fallin—conference room
Jake and Nick enter the room followed closely by Burton. Frank is reading Traveler magazine and sets it aside.
Jake: Frank. How are ya? (Shakes hands)
Frank: Fine.
Nick takes his seat without a greeting.
Burton: (Shakes hands) Hey, Frank. I'm sorry we're late.
Frank: Oh, no problem.
Burton: How in the hell are ya?
Frank: Well, just trying to clear some stuff off my plate.
Burton: Yeah?
Frank: Wanna get out of town this weekend. Told this girl – woman, a grad-student – I'd take her up to Vermont.
Burton: Oh, good. Good. (Mary brings in a tray of bagels) Oh, thanks, Mary. Looks good.
Frank: You getting much skiing in, Burton? (Looks Mary over as she leaves the room)
Burton: No. Not this season.
Frank: How old is that woman?
Burton: Mary? I don't know.
Frank: D'you think she's over 50?
Burton: (Chuckles) I don't know.
Nick: (Interjects) Brian Olsen sued the Hospital for wrongful termination.
Jake: And he's asking for one point three million.
Frank: He lied about being an epileptic. Now he's blaming us.
Nick: He's claiming the Hospital didn't give him a fair hearing.
Frank: She looks crazy.
Nick: Who?
Frank: That blonde out there.
Nick: Do you want to litigate?
Frank: Not particularly.
Burton: Okay. We'll see what we can do, all right?
Scene: Fallin & Fallin—Nick's office
Nick is bent over the work on his desk.
Mary: Excuse me. (Stands in Nick's open door holding a FedEx package) This came for you.
Nick: Oh. Just on the table's fine. Thank you.
Mary: Oh, your plant's dying.
Nick: (Looks over his shoulder at the plant on his credenza) Uh…
Mary: See, that kind needs more direct sunlight.
Nick: Okay.
Mary: May I move it?
Nick: Sure. (Tries to concentrate on his work)
Mary: (Moves his plant to the window sill) Needs a new pot, too. Could I pick one up for you?
Nick: (Hesitantly) Sure.
Mary: You're supposed to take off the dead leaves. (Walks over to him and rubs her hand on the shoulder of his jacket—he looks around at her hand) Oh, this is nice.
Nick: Yeah, it's Italian.
Mary: Very fancy. Your father, he could use a little bit of a fashion upgrade.
Nick: Yeah. (Chuckles and leans back in his chair still holding his pen) You know, Mary, he didn't tell me that you were living together.
Mary: Well, it's not like romantic.
Nick: Right. What is it?
Mary: Friendly.
Nick: Friendly?
Mary: We're friends.
Nick: I see.
Scene: Legal Services of Pittsburgh—Nick's office
Sam Farrell: (Wearing a long wig and dressed in women's clothes) Arthur was married before we met. He and his wife had a son, Timmy. He's twelve.
Nick: Where's the mother now?
Sam: She is at St. Mary's Cemetery. She died nine years ago—ovarian cancer.
Nick: And Arthur is your boyfriend. And, when did he pass away?
Sam: Three months ago. Motorcycle accident. But I don't have custody of Timmy.
Nick: Did you try to adopt him?
Sam: No. We thought, you know, maybe the laws would change so we could get married but… You do know I'm a man, don't you?
Nick: Yeah. I put it together.
Sam gives a weak laugh. Alvin knocks and enters, and hands Nick a handful of mailer inserts.
Alvin: When you get a chance, we're doing a mailing—a fundraiser. Maybe you can send some out? (Gives Sam a curious look)
Nick: Yeah. I'm kinda busy.
Alvin: Uh. Okay. (Exits)
Nick: So, Social Services they came to your house two days ago and…
Sam: Right. Someone made a phone call. And the problem is is that some of my friends were over at the house and someone was smoking a joint.
Nick: Were you smoking?
Sam: No.
Nick: Where was Timmy?
Sam: In his room. Sleeping. I told the Social Services guys that I was sorry and he just wouldn't listen. And they just barged right in there and they just took Timmy.
Nick: Okay. I'm going to try and schedule a shelter hearing. (Hurriedly gets up and opens the door)
Sam: (Starts to snivel) I've raised him since he was three. He's my son.
Nick: Legally he's not. (Sam gets up and leaves) All right.
Sam: Thank you. (Nick closes the door)
Scene: Legal Services of Pittsburgh—Lulu's office
Brian enters.
Brian: Hey. Just got a call from Mel Lavin. County wants to settle.
Lulu: That's great.
Brian: Well, depends on what they offer.
Lulu: Yeah, but it's a good sign if they want to negotiate.
Brian: Well, unless they come close to a million, they can kiss off.
Lulu: Oh, Brian, come on.
Brian: No, they fired me – for nothing. Didn't even give me a chance to explain.
Lulu: I know but you did lie on your application.
Brian: Hey, my epilepsy? It's irrelevant. My evaluations have always been great.
Lulu: I know that. I'm just saying a jury might not be so sympathetic. It makes sense to listen, that's all.
Brian: Yeah, well, I'll listen – when they come up with a million dollars.
Lulu: You still going to Columbus?
Brian: Yeah, the interview's Thursday. (Opens the door to exit—Nick comes in carrying a box)
Nick: My father's law books. (Sets the box on her desk)
Lulu: What?
Nick: You won the silent auction. (Grins and looks from Lulu to Brian as he leaves)
Brian: I'll call ya. (Exits)
Scene: Olsen residence—evening
Lulu opens the box of 'law books' to find a slide carousel and photo album instead of the books. The carousel is marked “Fallins 1974–1979”. She slowly takes out the photo album, opens it and smiles as she looks at young Nick and his mother at the beach.
Scene: Burton's residence
Burton, Mary and Shannon are in the kitchen. 'At Last' by Etta James plays in the background.
Burton: Shannon. This is a good paper, baby. Very good.
Shannon: Think so?
Burton: Yeah. Absolutely.
Shannon: Cool.
Mary: Ha.
Burton: I'm not so sure Abe Lincoln was President during the Revolutionary War but other than that, it's awesome.
Mary: Proud of you.
Shannon: Thanks.
Mary: It's time for bed.
Shannon: Already?
Mary: Uh-huh.
Shannon: Okay. Goodnight.
Mary: (Hugs Shannon) Goodnight. I'm so proud of you.
Shannon: Thanks. 'Night, Burton.
Burton: 'Night, Sweetie. (Kisses her on the head as she hugs him) Sweet dreams.
Shannon: Sweet dreams.
Burton: Okay.
Shannon: See ya.
Burton: How 'bout a glass of wine? Cheers. (They clink their glasses and take a sip) Come here. Put that glass down.
He takes Mary in his arms and begins to dance around in the kitchen.
Mary: Oh… oooh!
Burton: Remember this?
Mary: Yes.
Burton: God, she was great.
'…my heart was wrapped up in clover, the night I looked at you' ... They slowly kiss. Mary pulls away.
Mary: Oh…
Burton: Was that okay?
Mary: If you want.
Burton: If 'I' want?
Mary: Yeah, it's… it's okay, if you want.
Burton sighs. '…I found a thrill to press my cheek to…'
Burton: I think maybe I better turn in. I'll see ya tomorrow, okay? (He starts to walk away)
Mary: Burton… Wait, Burton. I didn't mean… maybe we could try tomorrow.
Burton: Maybe. (Walks away)
Scene: Amy Heckt's apartment
Jake is in the throes of ecstasy…
Jake: (Pants) Oh, it's crazy. Oh, you… you are… Oh, it's crazy. Oh, my God! I'm not that kinda guy usually… But you…
Amy lights a cigarette. Jake laughs.
Jake: And I'm not always comfortable with that thing you did but you gotta know. Can I have a drag?
She lets him have a drag from her cigarette then he flops back on the bed and reaches for a bottle of vodka on the nightstand.
Jake: You want another drink?
Amy: Hmm. (Laughs and climbs back on top of him, taking a drink from the vodka bottle)
Jake: Hey, is this, like, a problem for you?
Amy: How?
Jake: Well, I mean, your, you know, your achiever award.
Amy: Hmm, the award. I know, right.
Jake: What?
Amy: I don't even know Alvin Masterson. I went to see him, like, maybe five times.
Jake: And the whole achiever thing…?
Amy: I think he likes the way I look. He can have my achiever award, you know? (She kisses him—he begins to breathe heavily) Hmmm. It's been awhile, hasn't it?
Jake: Yeah.
Baby cries.
Scene: Fallin & Fallin—conference room
Nick enters the conference room—Burton, Brian, his lawyer and Lulu are already present. Nick does not sit down. Burton conducts the negotiations.
Burton: Here's Nick. So, Mel, does your client have to be here?
Mel Lavin: He'd like to be.
Burton: And Mrs.…?
Mel: …is an attorney.
Burton: Ah. Okay. Well, I'm gonna be candid.
Mel: They understand.
Burton: The offer is $25,000.
Mel: Burton…
Burton: That's the number we assign to nuisances.
Mel: Burton, this is hardly a nuisance. County Hospital terminated my client without a fair hearing.
Burton: Mel, your client is an epileptic who lied on an application. He's endangered the lives of numerous patients…
Mel: Burton, there's no proof that anyone was in danger…
Burton: Mel, please. That's the offer. Now you can take it or we can litigate. (Stands abruptly ending the negotiations) So, thanks for coming by. Oh and please say hi to Sally for me, will ya? (Shakes hands)
Mel: Thanks.
Burton: Good to see ya. (He exits with Nick—the others remain for a moment to discuss)
Outside the conference room—Nick hears Mary laugh and turns to see her talking with Frank in the lobby.
Frank: (Hands Mary a card) I have nothing to offer you but a bottle of wine and free medical care.
Nick continues to his office.
Scene: Fallin & Fallin—Nick's office
Jake: Hey. (Enters Nick's open door)
Nick: Hey.
Jake: (Closes the door) So, I woke up this morning, right? My head… just everything hurt. Her bed was so disgusting and her baby was screaming in the next room. And I had sweat through the sheets and the ceiling was all yellow…
Nick: Jake. Why are you telling me all this?
Jake: I feel terrible. Guilty.
Nick: Okay. All right.
Jake: I mean, you saw her, right?
Nick: Yeah. Yeah. She's a good looking girl. (He smiles broadly) But, you know, a woman like that… what she's been through, she's gonna have some baggage and I'd steer clear.
Jake: Well, I'm not going back.
Nick: Right. Well, you say that now 'cause you're hung-over. By 6:00 you'll be feeling a little better and then at 9:00 you'll be sitting in your apartment, alone…
Jake: No, I was just thinking about the – you know, about that kid. Maybe I should do something.
Nick: If I were you, I'd just stay away.
Scene: Judge Damsen's courtroom
Nick: Timothy Silber was removed from his home because of an over-zealous social worker. He came into the house and saw a group of transvestites and other individuals congregated downstairs while Timothy was upstairs, asleep. There were no signs of abuse or neglect, just an alternative lifestyle on full display.
Daniel Birge: Your Honor, there was marijuana in the house being smoked and I take offense at Mr. Fallin's characterizations. I have always…
Nick: My client was not smoking marijuana. He was not in the possession of any drugs.
Judge Damsen: Mr. Birge, did you see Mr. Farrell smoking marijuana?
Daniel: No.
Judge Damsen: Thank you. Ms. Shaw?
Kate: Timothy Silber has lived with Sam Farrell for over nine years and wishes to remain with him. Timothy's mother died when he was three years old and Mr. Farrell has acted in that capacity since that time. It seems punitive to take him from the only home he's ever known based on an unsubstantiated allegation of smoking marijuana.
Judge Damsen: (Short pause to deliberate) I'm returning Timothy to his home. Mr. Farrell, in the future, no more drugs in the house. (Gavel down)
Sam: (Seems stunned) That's it?
Nick: That's it. (Stuffs papers in his briefcase and stands to leave)
Sam: (Laughs) Thank you. (Grabs Nick around the neck and hugs him) Thank you.
Nick: Hey. (Pushes him away and nods)
Nick follows Sam and Timothy into the corridor. Henry Silber comes around the corner and approaches Sam and Timothy.
Henry: Sam! Hi.
Sam: Hey!
Henry: Hi, Timmy.
Timmy: Uncle Henry.
Henry: Sorry. There was a ton of traffic.
Sam: You didn't have to come.
Henry: Well…
Sam: It's nice of you to be supportive, though. Anyway the whole thing was a big mistake.
Henry: Sam, no. I just… I came because I spoke with a lawyer. We filed a motion for custody.
Nick is standing nearby talking with another lawyer— overhearing, he turns his attention to their conversation.
Sam: You?
Henry: Kelly and me.
Sam: What right do you have?
Henry: I'm his Uncle, Sam. He's known me his whole life.
Sam: I'm his mother.
Henry: You're not. You know that. Grace was his mother. You were Art's good friend.
Sam: Art's… good friend? [Inaudible] Come on. (With his arm around Timothy, they turn to leave—Henry follows)
Henry: Sam, look, we've got plenty of room. Our kids really like Timmy. Please, we just want what's best here.
Henry turns around and sees Nick looking his way—Nick turns back around to the man he was talking with earlier.
Scene: Olsen residence—daylight
Lulu is at the coffee table, paying bills. Brian comes down the stairs carrying a bag.
Brian: So, I'll call you when I get there.
Lulu: Good.
Brian: We okay?
Lulu: Not great. Uh, student loans, mortgage, car payments…
Brian: Well, this job at Columbus Presbyterian looks promising. You know, it's Internal Medicine, private practice.
Lulu: I know $25,000 seems low but I think if we can get them up to a hundred grand, I think we should take it.
Brian: A hundred grand means nothing to us, Lulu. I mean, it's not gonna change anything.
Lulu: And a million dollars will?
Brian: Well, it might. (Pause) Well, I'll call you when I get to Columbus, okay? (Kisses her on the cheek)
Lulu: Okay.
Brian exits.
Scene: Legal Services of Pittsburgh—Nick's office
Henry: (Enters without knocking) Mr. Fallin?
Nick: Yeah. Do you have an appointment?
Henry: No. I'm Hank Silber. I saw you earlier today at the courthouse. I'm Timmy's uncle.
Nick: Oh, right.
Henry: I've been trying to reach Sam. But he won't talk to me.
Nick: Why?
Henry: I just thought he should know that Timmy called me last week from the shelter. Said he wanted to live at our house.
Nick: Okay.
Henry: He doesn't want to hurt Sam's feelings. He just doesn't want to live with him anymore. I just wanted to give you a chance to tell Sam. You know, break it to him so it doesn't have to come out in court.
Nick: Okay.
Scene: Burton's residence
Mary is watching a home shopping channel. Burton enters the room with the mail.
Burton: Your change of address is now working. (Hands her mail to her)
Mary: Thanks. I picked up your dry cleaning. I went to the market. I forgot the milk.
Burton: That's all right. So, about last night.
Mary: Yeah.
Burton: If you're not…
Mary: Burton, it's not that.
Burton: Well, I just don't want you to be uncomfortable at all.
Mary: Burton… no.
Burton: (Chuffs) On the other hand, I think you should know that I do have feelings for you.
Mary: It's just been a long time.
Burton: 'Course.
Mary: Just give me a chance.
Scene: Amy Heckt's apartment
Jake knocks on the door. Baby cries from within.
Babysitter: Yeah?
Jake: It's Jake.
Babysitter: Yeah?
Jake: It's Jake. (The babysitter opens door, holding the baby.) Oh.
Babysitter: You a friend of Amy's?
Jake: I was just in the neighborhood and, I'm…
Babysitter: No. Come on in. Come on in.
Jake: (Enters the apartment) Is she here?
Babysitter: She's coming right back. (Baby starts to cry) I've gotta get some smokes. (Hands the baby to Jake and grabs her coat) Can you watch the kid just a second?
Jake: (Starts to protest) Well, you know… I'm not… not…
Babysitter: I'll be right back. I'll be right back. (Makes a hasty exit)
Jake: Well, how long you gonna be? (Baby is really crying now) (To the baby) Okay. Okay. I got ya. (Shuts the door)
Scene: Legal Services of Pittsburgh—Alvin's office
Alvin's on the phone—Jake stands in the doorway waiting to talk to him.
Alvin: Does this also make regular coffee? And what's its capacity? Oh, fantastic. And you can have it here by Friday? Great. Thank you. (Hangs up) (To Jake) I'm sorry about that. Have a seat. (Sips his coffee) Oh, this stuff sucks. So, Jake, what can I do for ya?
Jake: Well, this is kinda sensitive. It's about a client of yours—Amy Heckt.
Alvin: Oh. You got the mailer. That's great. The pro-bono workshop starts a week from Saturday.
Jake: Yeah. Amy is still doing drugs and she's neglecting her child.
Alvin: (Pause) Oh?
Jake: I have first-hand information.
Alvin: (Sighs) I see.
Jake: So, I think you should call Social Services about that before something happens to the kid.
Alvin: Hold on. If you don't mind me asking, how did you get this information?
Jake: That's personal.
Alvin: Well, Mr. Straka. Amy Heckt is my client. If you feel her baby's in danger, you need to do… what you need to do. But, I can't help ya. I'm her lawyer.
Scene: Fallin & Fallin—conference room
Nick: The Hospital's willing to go to $45,000. The offer's good 'til 5:00 o'clock tomorrow.
Brian: 45 grand? You're kidding, right? (His lawyer lays his hand on his arm to calm him)
Nick: No.
Jake enters the room.
Jake: Sorry. (Takes a seat)
Brian: Uh-uh. You expect me to take…
Lulu: (Takes his arm) Brian. Brian.
Mel: (Stands to leave) We need to think about it.
Nick: Fine. But it's off the table at 5:01 tomorrow.
Burton: (Shakes hands with Mel) Good to see you, Mel.
Mel: Burton. [Inaudible]
Outside the conference room—Jake and Nick talk as they walk.
Jake: So, I called Social Services about Amy. Gave a report.
Nick: Okay.
Jake: They said they'd send someone out to her place. I think I did the right thing. I feel better about that kid.
Nick: (Not interested) Fine.
Jake: I think I did the right thing. (Nick leaves him standing—wondering)
Scene: Legal Services of Pittsburgh—meeting room
Nick: Timmy. You like living with Sam?
Timmy: Yeah. He's been around as long as I can remember. He's my… he's been… like my mom.
Kate: So you don't mind how he dresses?
Timmy: He's always dressed like that. Sometimes kids make fun of us but…
Nick: Your Uncle Hank. How well do you know him?
Timmy: Not too well. But he has a treehouse and his kids are cool.
Kate: Your Uncle says that you want to live with him. Is that true?
Timmy: I called him. I was scared.
Kate: Of what?
Timmy: They just took me outta my house and then I was alone in that shelter. I was afraid I couldn't go back home. So I called Uncle Henry.
Kate: Do you want to live with your Uncle?
Timmy: My dad was sick… before the accident.
Kate: Okay.
Timmy: And if he's sick… Sam's probably sick, too. And if Sam's sick…
Scene: Dressing room in a drag club
Nick follows Sam, who is dressed in drag.
Nick: (Looking around) You get paid for this?
Sam: (Sits at a dressing table) Are you kidding? (Laughs) This is just for fun. I'm an accountant. I have some private clients. I work from the house. (Brushes blush on his cheeks)
Nick: Timmy thinks that his father was sick. And I think he's concerned about your health, as well. Was he sick? (Sam nods) I'm sorry.
Sam: The motorcycle accident… I don't think that was really a motorcycle acc…
Nick: Right.
Sam: Does Timmy think I infected his father?
Nick: I don't know.
Sam: 'Cause I didn't. I'm healthy.
Nick: You been tested?
Sam: No.
Nick: Then how can you be sure?
Sam: I just know, okay? I've always been very careful…
Nick: Sam. Timmy is afraid. If you want him to be with you, you need to get tested.
Sam: (Sighs) When Art and I met and we fell in love, he didn't tell me about Timmy. I was young then and the last thing I wanted to do was take care of some guy's kid. But then he took me over to the house, right? And… there was Timmy… this skinny little thing… asking a million questions about how everything worked. And he needed a mom so badly. Nick: Well, then there's no point in going to court. Timmy won't be living with you. We can talk informally to Hank and maybe we can come up with some kind of arrangement.
Scene: Legal Services of Pittsburgh—Alvin's office
Amy: Social Services just took my baby.
Alvin: When?
Amy: About an hour ago.
Alvin: Well, I told you what Mr. Straka said. This shouldn't be a surprise.
Amy: But, it's not my fault. (Alvin shuts his door) When they came to my apartment my babysitter was drunk. And they found drugs—someone else's. What are we gonna do?
Alvin: We? Well, let's see. We already told the world that you were competent, responsible and drug-free.
Amy: I didn't ask you to do that.
Alvin: (Sighs) Right. Well, the problem is…
Amy: Wait! Problem? You drive 'me' to that party. You buy 'me' that dress. You force 'me' to make a speech. You sit me next to a guy, some guy who's probably a friend of yours, who does terrible things to me and you're not gonna help me now?
Alvin: I didn't say that. Look, I'll do what I can. But, Mr. Straka's prepared to testify that he saw you doing drugs and neglecting your child.
Amy: He saw me? Like he was just walking by my apartment? He drove me home that night, and we had a drink. And then he gave me a pill, and before I know it he's on top of me pulling at my clothes.
Alvin: I see. And you're gonna tell the police that?
Amy: He came back three nights in a row. And I got friends who can tell that to the cops.
Alvin: (Sighs) That's what you're gonna say?
Amy: If they ask me, Alvin, I gotta tell 'em the truth.
Burton's residence
Nick knocks on the door.
Mary: (Opens the door) Hi.
Nick: Did my dad leave a file for me?
Mary: A file?
Nick: Yeah. He said it would be on his desk.
Mary: I don't know.
Nick walks to the desk and picks up the file.
Mary: Nick.
Nick: Yeah? (Turns to face her—she's dressed in a gown and robe)
Mary: About your dad. We're not…
Nick: Mary, I don't care.
Mary: I just want to say that we're not involved the way you might think we are.
Nick: Really, I don't care.
Mary: I don't want to hurt him. I think he's a wonderful person.
Nick: I understand that.
Mary: And I want to do something for him, you know, to thank him.
Nick: Well, I don't think he's gonna want anything.
Mary: Well, I know he likes to smoke… and he likes red wine and… he likes sports. (She steps closer to Nick) I know that. So I'd like to get him a present. Don't you think?
Burton enters the room.
Burton: Hey.
Mary quickly pulls her robe together. Burton looks, curiously, at the two of them, as he removes his coat.
Scene: Olsen residence
Lulu is alone watching the Fallin family slides. She doesn't hear Brian come in. He's carrying a bottle of champagne.
Brian: Who is that? (Picture of Burton with young Nick on his shoulders at the beach)
Lulu: (Startled—flustered) Ah, they're old pictures of the Fallins.
Brian: Oh. Well, I got the job. They want me start next week. Even offered to pay for an apartment so that you'd be more comfortable with the transition. (Chuffs)
Lulu: Brian…
Brian: I was gonna surprise you… but, well, I guess I did.
Lulu: This isn't wh… It… this was a mistake.
Brian: Yeah. I agree.
Lulu: No, I mean… (Sighs) You know the books that I bought – when I opened up the box they weren't… this was there, and… I'm glad you got the job.
Brian: Yeah. Yeah, me too.
Lulu: You should take it.
Brian: Yeah. Yeah.
Scene: Fallin & Fallin—conference room
Jake and Alvin enter the room and close the door.
Alvin: Amy Heckt.
Jake: Yeah.
Alvin: They went to her house and found some things, and took the child.
Jake: Well, it's probably the best thing. I mean, I didn't want to do it but, I mean you can't leave a kid in a situation like that…
Alvin: One of the things they found – your Codeine prescription.
Jake: Uh-huh.
Alvin: One of the thing's Amy's saying…
Jake: Right.
Alvin: …that you…
Jake: Right. Right. That I slept with her, and I also took care of the kid.
Alvin: But, she's not saying that… exactly. Her take is that you assaulted her, attempted to rape her and held her child against her will.
Jake: That's absolutely ridiculous.
Alvin: I'm sure.
Jake: Is she willing to say this in court?
Alvin: She plans to.
Jake: Has she talked to the police?
Alvin: No.
Jake: Okay. So, whadda ya recommend then?
Alvin: Hard way—fight for what you know is true. Easy way—say it's all a mistake.
Scene: Fallin & Fallin—Nick's office
Jake: (Agitated) One, she's an addict. And two, she's lying.
Nick: And three, you slept with her. (Nick is bent over his desk—continues to work)
Jake: She's lying.
Nick: So what.
Jake: So, she's lying!
Jake exits as Brian enters, carrying the box of Fallin family photos. Nick is unaware that Brian has entered.
Nick: Well, you just gotta let it go, man. A woman like that… just let it go. (Looks up to see Brian) Brian.
Brian: You mixed up the boxes.
Nick: What?
Brian: It's a bunch of pictures and slides of your family. Lulu had 'em.
Nick: Well, my father must have mixed 'em up.
Brian: Yeah. Well, I'll accept the offer—45—if it's still good.
Nick: (Checks his watch) Yeah.
Brian: All right, well, I'll accept it.
Nick: Well, have your lawyer call me.
Brian: Yeah, I'll do that.
Nick: Good.
Brian: You know, about Lulu, it's, uh… She's… uh… Well, I'll have my lawyer call ya.
Scene: Legal Services of Pittsburgh
Nick exits the elevator and walks right by Sam, dressed like a man. Pours a cup of coffee.
Sam: Nick.
Nick: (Appears not to recognize Sam) What?
Sam: Sam.
Nick: Hey. (Smiles) Hey, Sam.
Sam: Took your advice. (Hands him a piece of paper) I'm negative.
Nick: That's good, Sam. That's good. Have you told Timmy?
Sam: Yeah, this morning, as soon as I got the results.
Nick: Good. That's good.
Scene: Legal Services of Pittsburgh—meeting room
Sam: Timmy. We didn't want – your dad and me – to tell you certain things. We felt that it was too much let alone you knowing that your father was sick. Timmy, I'm healthy. I'm fine. And I didn't hurt your dad. I loved him. And I took care of him. And I love you, and I want to take care of you, too.
Kate: It's up to you, Timmy. You just tell us what you want. (Pause) Timmy, would you rather speak to the Judge about this?
Timmy: I think I want to be with Uncle Henry.
Sam: You think?
Timmy: I'm sorry, Sam, but…
Sam: But, we're a family.
Timmy: I just want to be with Uncle Henry.
Sam: I can dress like this from now on.
Timmy: I'm sorry, Sam. (Gets up and hugs Sam)
Sam: (Sobs) Oh, God. It's okay. It's okay.
Scene: Fallin & Fallin—conference room
Nick: This is the settlement agreement. Once your client signs, we'll messenger over a check.
Mel: We're done.
Burton: Great.
Mel: Burton. (Shakes hands)
Burton: Good to see ya, Mel.
Mel: Nick. (Shakes hands)
Nick: Thank you.
Burton: Take care.
Frank: Terrific job.
Nick: Well, it wasn't so hard.
Frank: Well, terrific. You guys are pros.
Burton: Well, thanks.
Frank: You know, I asked out that blonde from the reception desk.
Burton: Oh…
Frank: Yeah, taking her to the Benedum Center next week and then to Anthony's for dinner and then… Yeah, I bet she's wild. Thanks. (Shakes hands)
Burton: Yeah, okay. Take care. (Frank leaves—Nick gives his father a look) What? (Nick walks away)
Later—Reception desk
Mary: Fallin & Fallin. Please hold. Fallin & Fallin. Please hold.
Burton: (Walks up to the reception counter) (To Shannon) Hey, Sweetheart.
Shannon: Hey, Burton.
Burton: How ya doing?
Shannon: Good. How are you?
Burton: Good. Good. You got a second, Mary?
Burton returns to his office—Mary follows and closes the door.
Burton: I've been thinking, Mary.
Mary: Yes.
Burton: This isn't working out.
Mary: Yeah. Burton, let me explain. I know I should feel a certain way about you. I mean, I don't know what's wrong with me.
Burton: Well, I'm not asking.
Mary: It's all my fault.
Burton: (Extends his hand—she takes it) Good luck.
Mary exits—Burton watches through his office window as Mary and Shannon gather their things at the reception desk and leave—Shannon giving him a final look.
Scene: Legal Services of Pittsburgh—Lulu's office
Nick: (Delivers the box of books) Your law books.
Lulu: Oh, but…
Nick: Brian dropped the other box off. I'm sorry about the mix-up. (Smiles and leaves)
Lulu: Oh…
Scene: Legal Services of Pittsburgh—meeting room
Jake is giving a statement to a representative. Alvin and Amy are also present.
Jake: The Codeine was obviously mine. My back is out and I brought the pills to the apartment and I accidentally left them there. Here's a copy of the prescription. And the phone call – I made the phone call because I was upset. Amy and I had a fight, we had a disagreement. She said she didn't want to see me again so I… made the call. And it wasn't meant to be malicious. I mean, I was just concerned about the baby. But, perhaps some of the things I said were misconstrued. I was calling about the babysitter. She was drunk. But, that's not Amy's fault. She loves her baby very much. Anything else?
Scene: Legal Services of Pittsburgh—bullpen
Following the meeting.
Amy: (Holding her baby) Yeah. Yeah. Good baby. (To Alvin) So, that's all there is?
Alvin: Yeah. You're all set.
Amy: Well, Mr. Masterson. You people have been so good to me. (Kisses him on the cheek and leaves)
Nick walks up, sighs, and folds his arms as he watches Amy walk away.
Alvin: Well.
Nick: Well. (They share a look)
Deliveryman: Delivery for Alvin Masterson.
Alvin: Awesome. The new stuff's here. Where's that new espresso machine? What, did you leave it in the truck? You brought it, didn't ya?
Scene: Burton's residence
Burton sits alone with a drink, watching the Fallin family slides.
