2 INT. OPS

DAX and KIRA at their stations. SISKO is in his office.
O'BRIEN is at Dax's station, a small traveling case strapped
to his shoulder, hurrying to EXIT...

					O'BRIEN
... and I downloaded the new docking
procedure checklist for Bay Six into
			the Bay-Prod D-Nine file. That's
the only bay that's using the new
			criteria.

					DAX
			Got it.

He moves to his station and picks up a couple of small
PADDS... putting them in his case...

					O'BRIEN
				(continuing)
And be sure to monitor the power
			fluctuations in the secondary fusion
core. It's got some little kinks I
			don't like the look of.

					DAX
				(dry and deliberate)
I'll care for the secondary fusion
core like it was my own child.

Moving to the Turbolift... to Kira as he passes...

					O'BRIEN
As soon as I get back I'll run a
full diagnostic to be sure that...

					KIRA
			Chief, we're perfectly capable of
running this place for a week.

					O'BRIEN
				(acknowledges)
If there's any problem you can reach
			me on subspace.

					KIRA
				(overlapping)
Would you please go on vacation and
			get out of our hair?

He acknowledges, crosses up to the Turbolift.

					DAX
			Miles?

					O'BRIEN
				(turns back to her)
			Yes?

					DAX
				(a smiles)
			Have a good time.

					O'BRIEN
			Oh... right... Thanks. I already
			feel relaxed...

And he goes into the Turbolift and it goes down. Sisko ENTERS
	from his office.

					SISKO
			Is he gone?

					KIRA
			Finally.

					SISKO
Good. He's been driving me crazy
all day. You'd think I was...

The Turbolift rises just enough to see O'Brien's head...

					O'BRIEN
Ah... Commander... I forgot to tell
you. I added a new subroutine to
			the environmental control for the
			Habitat Ring...

					SISKO
			Chief O'Brien...

					O'BRIEN
			Yes, sir?

					SISKO
				(mock stern)
			You're on leave. Please disembark
			this station.

					O'BRIEN
			Aye, sir.

The lift descends. Kira and Sisko react, and we...

3 INT. PROMENADE

As O'Brien makes his way, running late now, and hurrying.

4 ANGLE UP PROMENADE

We see a man come out of one of the shops. A tall, rugged-
looking fellow we will come to know as BOONE. Boone turns
and looks toward O'Brien, sees him, reacts slightly as if he
recognizes O'Brien, but is not sure. He makes sure O'Brien
makes eye contact... and once he does, O'Brien reacts,
	recognizing the man...

5 WITH BOONE AND O'BRIEN

as O'Brien comes up to him.

					O'BRIEN
			Boone... ?

Boone continues his polite, if puzzled, smile.

					O'BRIEN
				(continuing)
			O'Brien. Miles O'Brien. We served
			on the Rutledge together.

					BOONE
			O'Brien. Of course. It's been a
			long time. How're you doin?

					O'BRIEN
Fine... fine... I work on this station
			now. Chief engineer.

					BOONE
			You don't say...

					O'BRIEN
				(re: civvies)
How long you been out of Starfleet?

					BOONE
Almost eight years now. I've settled
			on Volan Three.

					O'BRIEN
That's on the Cardassian side of the
			Demilitarized Zone, isn't it...

             DEEP SPACE: "Tribunal" - 03/29/94 - TEASER 5.

5 CONTINUED:

					BOONE
Yeah, the new treaty really puts us
			in harm's way. But I'm running a
ladarium mining sluice. As long as
			the Cardassians need ladarium for
their warp drives, they leave me
			alone.

					O'BRIEN
After what we went through in the
border wars, I don't know how you
			could live there.
				(can't remember)
Were you there at Setlik Three?

					BOONE
				(acknowledges, ugly
				memories)
That's why I got out of Starfleet.

					O'BRIEN
Really. That's why I stayed in.
				(beat)
Listen, my wife's meeting me at a
runabout... and she hates it when
I'm late... and I always am...

					BOONE
				(calling after him)
I'm coming back for another supply
pickup in a month or two.

					O'BRIEN
			Let me know when...

Boone watches him go a moment, the smile fading. Then he
	heads in the other direction.

6 INT. SUPPLY CLOSET

Dark as the door opens and Boone ENTERS, the door slides
shut, leaving him in shadows... the only light source is
from a small PADD that Boone takes out from under his
jacket... it contains a miniature keyboard. Boone goes to
	work at the keyboard.

					O'BRIEN'S VOICE
				(playing back from
				the PADD)
			O'Brien. Miles O'Brien... we served
			on the Rutledge...

Boone reacts, satisfied that he got the recording and as he
hits the keyboard, we hear O'Brien's voice, speeded up as
the tape fast forwards... and we...

8 INT. RUNABOUT

O'Brien is at the control panel, reading some PADDS... from
	the back room --

					KEIKO (O.S.)
			Miles...

					O'BRIEN
			Hah?

					KEIKO (O.S.)
			Didn't you bring the holo-cam?

					O'BRIEN
			Was I supposed to?

	KEIKO sticks her head in...

					KEIKO
You said you were going to...

					O'BRIEN
			I did?

	She ENTERS...

					KEIKO
Last night? When we were going over
			the list in bed...

					O'BRIEN
I was dead the minute my face hit
			the pillow.

					KEIKO
You talked to me for a half hour.

					O'BRIEN
Not me. There must've been someone
			else in bed with us.

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT ONE 8.

8 CONTINUED:

					KEIKO
				(seeing the PADDS)
			What's this...

					O'BRIEN
			Just some new technical update
			manuals...

She sits in the other chair...

					KEIKO
Our first vacation without Molly in
five years and you brought technical
			update manuals?

O'Brien doesn't get the message, takes the conversation in a
	different direction...

					O'BRIEN
You know, maybe we should've brought
her... you really think she's gonna
be all right with the Petersons?

					KEIKO
Molly likes the Petersons more than
			she likes us. She's fine.

					O'BRIEN
We could swing back, pick up the
holo-cam and Molly and barely lose a
			half day...

	Off Keiko's stare...

					O'BRIEN
				(continuing, regrouping)
...Or... I'm sure we can pick up a
			holo-cam when we get there...

Keiko sighs, tension on her face, leans back...

					KEIKO
			How many?

					O'BRIEN
			What?

					KEIKO
			Tech manuals did you bring?

					O'BRIEN
			Not many.

DEEP SPACE: "Tribunal" - REV. 04/07/94 - ACT ONE 9.

8 CONTINUED:	(2)

She doesn't even look at him, just shakes her head...
O'Brien puts down the PADD... sighs...

					O'BRIEN
			Computer, play something by Minezaki.

The soothing music comes on. Keiko closes her eyes, takes
it in... feels the connection between her and her husband...
he gets up and leans down and kisses her gently on her closed
left eye, then her right eye... she reaches her arms around
his neck and pulls him into a more passionate kiss... but it
is awkward because of the chair... intimately --

					KEIKO
			Do these chairs recline?

					O'BRIEN
			I wish they did.

					KEIKO
			You're an engineer. Figure something
out. I'll make it worth your while.

The music is interrupted by the Computer Voice --

					COMPUTER VOICE
			Vessel approaching. Bearing one-
			nine-one mark six.

DEEP SPACE: "Tribunal" - REV. 04/07/94 - ACT ONE 10.

					COMPUTER VOICE
			Cardassian patrol ship, Hideki Class.

					O'BRIEN
				(instantly alert)
			Shields up.

9 EXT. SPACE - RUNABOUT (OPTICAL)

as a Cardassian patrol ship moves to intercept.

10 INT. RUNABOUT (OPTICAL)

O'Brien has moved back to his seat... the music has stopped.

					O'BRIEN
Try to send an emergency subspace
			signal to the station...

Keiko looking at her console... presses a few panels...

					KEIKO
			I can't... they're jamming all the
			subspace frequencies...

					O'BRIEN
				(notices something on
				console)
			They're hailing us.

O'Brien throws a switch. The image of GUL EVEK appears on
the monitor... he is calm and irritatingly polite.

					O'BRIEN
This is Chief Miles O'Brien from
			Starbase Deep Space Nine... state
			your business.

					GUL EVEK
			Mister O'Brien, we've spoken before.
			My name is Evek.

DEEP SPACE: "Tribunal" - REV. 04/07/94 - ACT ONE 11.

10 CONTINUED:

					GUL EVEK
Shut down your drive and come to a
			full stop. We're beaming an
			inspection team aboard.

					O'BRIEN
			We're nowhere near the Cardassian
			border... you have no authority
			here...

					GUL EVEK
			We'll argue about authority later.
For now, you will either comply, or
			we will take preemptive action.

					COMPUTER VOICE
			Warning. Sensors are reading photo
			lock-on activation.

					GUL EVEK
			You have ten seconds.

O'Brien's mind races... there are no other ways out of this...
finally, O'Brien hits some controls, then rises and goes to
	Keiko.

					O'BRIEN
It's all right, love. We've done
			nothing wrong.

	They turn to see --

11 WIDER ANGLE (OPTICAL)

As three Cardassians transport aboard the runabout. Gul
	Evek steps forward.

					GUL EVEK
			Thank you for cooperating.
				(producing small PADD)
I have orders to arrest you, Mister
			O'Brien.

					KEIKO
			Arrest...

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT ONE 12.

11 CONTINUED:

					GUL EVEK
				(to the officers)
			Search the ship.

The two officers EXIT into the cargo area of the ship.
	O'Brien moves forward.

					O'BRIEN
			What are the charges?

					GUL EVEK
				(ignoring him)
You have the right to refuse to answer
questions, but such refusal might be
construed as a sign of guilt...

					O'BRIEN
I demand to know what I'm being
			accused of!

					GUL EVEK
You deny all knowledge of this crime
			then...

					O'BRIEN
How the hell am I supposed to deny
something when I don't even know
			what you're talking about...

					GUL EVEK
So you do not deny all knowledge...

					KEIKO
We are Federation citizens and we
			have rights...

					GUL EVEK
Yes... yes... all your "rights" as
			defined by the Cardassian Articles
			of Jurisprudence will be protected.

					O'BRIEN
I want to speak with my Commander.

The two Cardassian officers return and look at Gul Evek,
nodding to him that they've found what they were looking
	for.

					GUL EVEK
We will contact your commander. And
see that your wife is returned safely
			to your station.

DEEP SPACE: "Tribunal" - REV. 04/07/94 - ACT ONE 13.

11 CONTINUED:	(2)

Evek takes Keiko by the arm to pull her away from
O'Brien... as the First Officer moves to take him into
	custody...

					GUL EVEK
				(continuing)
You will be taken to central prison
on Cardassia Prime to await trial.

This is too much for O'Brien. He pushes the First Officer
	away...

					O'BRIEN
I'm not going anywhere with you...

The second officer downs the fighting O'Brien with a stun
blast from a phaser. O'Brien drops to the floor.

					KEIKO
			Miles!

Evek activates his transporter and he and O'Brien vaporize
	off the runabout.

12 KEIKO

restrained by the remaining officer is distraught, and we...

13 EXT. CARDASSIA PRIME - MATTE SHOT (OPTICAL)

In the shot we can see a large outdoor screen or two... with
constant messages bombarding the populace... on the screen
now, is a Cardassian man speaking... we're too far away to
discern any words... but we can see his image dissolve to a
Cardassian symbol... and a word in Cardassian language that
should look very alien -- the word means "children"... and
then a picture of several Cardassian children is on the
screen... and this word is superimposed several times over
the picture... and is replaced by a stirring shot of
Cardassian ships in space... and the Cardassian symbol
superimposed over the space shot... replaced again by the
anchorman who continues his stern lecture... We move in on
	an imposing-looking institutional building.

					CARDASSIAN ON SCREEN
				(unintelligible
				distance)
Look to the children -- they are the
future of Cardassia and they will
lead the way. Invest in their minds,
teach them carefully of the glories
of the Cardassian Empire and they
will bring us greater glory for years
to come. It is every mother and
			father's responsibility to see that
his child is living up to his full
			potential as a Cardassian citizen...

14 INT. PRISON PROCESSING AREA

And it is extremely dark... too dark to pick up anything but
the vaguest details of where we are... we start close on the
door as it opens and two Cardassians pull a belligerent
O'Brien inside... immediately he squints as, in front of
him, a huge bright spotlight is pointed at him...

My name is Miles O'Brien. My rank
			is chief of operations, Starfleet.
			I am a Federation citizen...

In the middle of the above speech, he is dragged off his
feet and because it is so dark it is unclear where he will
land... it turns out to be against a wall where he is pressed
face-first against it... as one of the guards uses a knife
to rip his clothes down the back and off... continuing to
	intercut with:

16 THE LIGHT

					DISEMBODIED CARDASSIAN VOICE
Would you care to make a confession?

17 O'BRIEN (OPTICAL)

	naked now...

					O'BRIEN
My name is Miles O'Brien. My rank
			is chief of operations, Starfleet.
			I am a Federation citizen...

					DISEMBODIED CARDASSIAN VOICE
			Process him.

O'Brien is dragged again through the blackness and held in
front of a large medical piece of equipment that sends out
optical red scanner beams into both of his eyes... on a
monitor we may see an Okudagram of O'Brien's eyes graphically
reconstructed with Cardassian labels and numbers, suggesting
identification... a larger number at the bottom designates
this as "41302Z" (the "Z" being a Cardassian symbol)... a
moment later he is pulled away in another direction and finds
	himself being pushed into...

18 ANGLE

revealing a chair... like a dentist's chair or an electric
chair... and as they start to attach restraints, he gets
very scared and for the first time fights for his life... he
does not want to be in that chair... whatever the hell it
is... and he bursts out of it... elbowing one guard as he
	goes... into the darkness...

             DEEP SPACE: "Tribunal" - 03/29/94 - ACT TWO 16.

For an instant we hear a struggle and violent impact from
the darkness and a moment later the light finds him being
dragged back to the chair... he's bruised on his head now,
but he's still struggling... and as someone moves in to him...

19 O'BRIEN

	reacts as he sees --

20 HIS POV -- A HYPOSPRAY

	in a Cardassian's hands...

21 HIS EYES

strain as the others hold him down... panning down to his
neck as the hypospray is pushed into his neck and his
	resistance immediately ends...

22 WIDER

he is still fully conscious but no longer able to lift a
muscle to defend himself... his body shivers as though he
were very cold as the guards finish locking him into the
	chair...

					O'BRIEN
My name... is Miles O'Brien. My...
			rank... is... chief... operations,
			Starfleet. I... am a... Federation
			citizen...

23 CLOSE ON HIS HAIR

as a Cardassian hand uses a scissors to snip a lock of hair
and puts it into a clear evidence container -- designed for
this very purpose... it too is marked "41302Z"...

24 THE CHAIR

	TILTS BACK... AND

25 O'BRIEN'S POV

A guard with a dental tool approaches --

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT TWO 17.

26 ANGLE

as the guard forces O'Brien's mouth open and sticks the tool
inside... O'Brien tries to yell but it is barely a moan...
the man yanks and removes a tooth from the back of O'Brien's
mouth... he moves away and inserts it next to the hair in
the evidence container... O'Brien is left there to shiver...
and after a beat a bright blue light overhead illuminates
and almost blinds our view of O'Brien... he stops shivering...
and as it ends a beat later... the guards move to release
O'Brien... and he finds himself covered in a fine gray ash-
	like powder...

27 ANGLE - IN THE BACKGROUND

the door opens and a Cardassian woman, MAKBAR, ENTERS. As
O'Brien is given prisoner wear, which he weakly puts on...
	Makbar studies him...

					MAKBAR
			Has he been processed?

					DISEMBODIED CARDASSIAN VOICE
			He has.

She sees the bruise on his head... reacts, angrily... she
	speaks with quiet, cold danger...

					MAKBAR
You were told he was not to be
			harmed...

28 THE LIGHT

					DISEMBODIED CARDASSIAN VOICE
			He had to be restrained.

					MAKBAR
			You were told.

	She turns to a guard...

					MAKBAR
You are in charge here now.

The guard is delighted... moves off to do his work...

					DISEMBODIED CARDASSIAN VOICE
				(protesting)
He has committed high crimes against
the Cardassian people! Why do you
			protect him?

DEEP SPACE: "Tribunal" - REV. 04/05/94 - ACT TWO 18.

28 CONTINUED:

During the above, a barely discernable figure of a
Cardassian man is dragged away by two guards passing briefly
in front of the bright spotlight.

					MAKBAR
			You were told.

	And they are gone.

29 ANGLE (OPTICAL)

O'Brien watches this craziness as he dresses... Makbar moves
to a cell and turns off a forcefield... leads the weakened
O'Brien by the arm as she speaks to him...

					MAKBAR
I apologize for the way you've been
treated, Mister O'Brien. I am Makbar,
Chief Archon. I want your stay here
to be as comfortable as possible
			under the circumstances. I have
scheduled your trial to begin in two
days. You have been assigned the
			Venerable Kovat as Public Conservator.

					O'BRIEN
			As what?

					MAKBAR
Your lawyer. Many feel he's the
			best counsel in all Cardassia.

					O'BRIEN
Why do I need a lawyer? What am I
charged with, and who is accusing
			me?

					MAKBAR
All in good time, Mister O'Brien.
			All in good time...

She turns on the forcefield and EXITS... O'Brien reacts with
	frustration.

31 INT. COMMANDER'S OFFICE

Close on Keiko, who is sitting opposite Sisko's desk. She is
composed, determined, trying to be strong. Sisko is standing
near her. ODO is also there.

					SISKO
			Starfleet has ordered the Enterprise,
the Prokofiev and the Valdemar to
			the border of the Demilitarized
			Zone... hopefully, when the
			Cardassians see they're risking the
			entire treaty over this...

					KEIKO
				(interrupting)
... and in the meantime, my husband
is being violated by them... every
shred of his humanity is being
			violated... isn't that true.

It is true... Sisko doesn't know how to respond... there's
	no way to soften it...

					SISKO
We have no way of knowing exactly
			what...

					KEIKO
Dammit, don't lie to me... They're
torturing him as we sit here.

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT TWO 20.

31 CONTINUED:

After he sits there for a beat, Odo quite directly
	addresses her...

					ODO
It is standard procedure for the
Cardassians to use torture in their
			interrogations. You are correct,
			Mrs. O'Brien.

A beat... Keiko shakes her head trying to absorb the reality
	of this horror...

					KEIKO
You don't know how many times Miles
spoke to me about this... what the
			Cardassians did to the prisoners
they took at Setlik Three... what
they were like when they came back...
the thought of it... it disgusted
			him... it scared him...

A tear rolls down her cheek...

					KEIKO
... we can't leave him there...

					SISKO
We don't even know where he's being
			held on Cardassia Prime...

Keiko nods silently, looking down, unable to tolerate any
more of this... she rises and moves to the door... Sisko and
Odo exchange a glance and follow her into...

32 INT. OPS

As Keiko comes onto the landing above Ops, followed by a
concerned Sisko and Odo. Kira and Dax at their stations.

					SISKO
Keiko, I promise you as soon as we
			have more information, I'll do
			everything in my power...

					KIRA
			Commander, you have a subspace
			communication from Cardassia Prime.

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT TWO 21.

33 ON SISKO AND KEIKO

	As they react to this.

					SISKO
			On screen.

We see the image of Makbar come up on the screen.

					SISKO
			I'm Benjamin Sisko, Commander of
			Deep Space Nine.

					MAKBAR
My name is Makbar, and I am the Archon
			representing the Cardassian Empire
in its case against Miles O'Brien.

					SISKO
			May I speak with him.

					MAKBAR
			That is not possible.

					SISKO
			May I see him.

					MAKBAR
			Commander...

					SISKO
May I be assured that he is well and
			being treated properly?

					MAKBAR
Mister O'Brien is being treated with
			great care and respect.

					SISKO
Good. Because if he's not, I'll
			hold you personally responsible.
And if that sounds like a threat, it
			is.

	Makbar blinks, then almost grins...

					MAKBAR
Gul Dukat has told me about you.
You live up to your reputation,
			Commander.

					SISKO
That's right. I do. Now what are
			the charges against Chief O'Brien.

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT TWO 22.

33 CONTINUED:

					MAKBAR
The charges will be announced when
the trial begins. As is customary
			in Cardassian jurisprudence.

					KEIKO
How are we supposed to prepare for
the trial if we don't know the
			charges?

					MAKBAR
			Mrs. O'Brien, I take it?

					KEIKO
			Yes.

					MAKBAR
Mrs. O'Brien, there is nothing for
			you to prepare. Your husband's
			verdict has already been determined.
He is guilty. The trial will reveal
how this guilt was proven by the
			most efficient criminal investigation
system in the quadrant. You may, if
you desire, attend the trial, which
			begins in two days time.

					SISKO
			We'll be there.

					MAKBAR
I'm sorry, Commander, this is a
privilege enjoyed only by the spouse
			of an offender.

Odo who has been thinking ahead during this conversation,
	steps forward...

					ODO
			What about his Nestor?

					MAKBAR
His Counsel and his Nestor will be
			assigned by the court.

					SISKO
				(to Odo)
			Nestor?

					ODO
			Advisor to the offender. Madame
Archon, I volunteer to serve as Nestor
			in this trial.

DEEP SPACE: "Tribunal" - REV. 04/04/94 - ACT TWO 23.

33 CONTINUED:	(2)

					MAKBAR
				(sighs, impatient)
That is not possible. The Nestor
must be an officer of the court.

					ODO
I am an officer of the Court.
				(off her reaction)
Chief of Security Odo... I served
Gul Dukat on Terok Nor. You may
			check my credentials. I was
			designated an officer of the
Cardassian court four years ago in
order to testify in criminal cases.

Makbar takes a beat to consider this...

					MAKBAR
Very well. If this is true, you may
accompany Mrs. O'Brien and serve as
			Nestor.

					ODO
May I ask... what penalty does Mister
			O'Brien face?

					MAKBAR
His execution is scheduled for next
			week.

					KEIKO
				(horrified)
How can you schedule an execution
before the trial even begins... ?

					MAKBAR
			We believe in swift justice.

She nods good-bye and the screen returns to the starfield.

33 CONTINUED:	(3)

					ODO
			Mrs. O'Brien, we should leave

	They move to the Turbolift...

					SISKO
				(to Kira)
Begin a complete security sweep of
the station and Chief O'Brien's recent
activities... I want to know if
there's anything out of the ordinary
that might begin to explain this...

	Odo and Keiko are gone.

					KIRA
			Commander, Chief O'Brien's attitude
toward the Cardassians is hardly a
secret. What if he's actually done
			something.

					SISKO
We need to know that too, don't we?

He returns to his office. Kira turns back to her work, and
	we...

	FADE IN:

34 EXT. CARDASSIA PRIME (OPTICAL)

An establishing shot of the capital city.

35 INT. O'BRIEN'S CELL (OPTICAL)

An older man (KOVAT) carrying a PADD arrives...

					KOVAT
			Miles O'Brien?

O'Brien looks at him from his cot, doesn't respond...

					KOVAT
Yes, of course you are. I am
			Conservator Kovat.

He turns off the forcefield... and ENTERS, sits in a chair...
Kovat has an unshakeable good humor and optimistic attitude,
but is not a buffoon. He believes in the system.

					O'BRIEN
I've been told that I've already
			been charged, indicted, convicted
and sentenced. What do I need with
			a lawyer?

DEEP SPACE: "Tribunal" - REV. 04/06/94 - ACT THREE 26.

35 CONTINUED:

					KOVAT
Mister O'Brien -- if it seems immodest
of me, I apologize, but the role of
Public Conservator is key to the
			productive functioning of our courts.
I am here to help you concede the
wisdom of the state. To prepare you
			to accept the inevitable with
			equanimity.

O'Brien can't help but laugh at this.

					KOVAT
				(continuing)
There is an old Cardassian expression --
"Confession is good for the soul."
It's also good for the populace to
see people like you confess. It
			makes them feel better about
			themselves. Makes their lives more
			bearable.

					O'BRIEN
Is that what this is all about? To
make the people of Cardassia feel
			better?

					KOVAT
No, but that's not a bad side effect.
			Now then...
				(checking his PADD)
			I have your biographical extract,
			Starfleet records, etc. These will
			be very useful...

					O'BRIEN
What am I being charged with?

					KOVAT
No need to worry about that at this
			point.

					O'BRIEN
			This is insane.

					KOVAT
			Whatever you've done, whatever the
charges against you -- none of that
really matters in the long run.

DEEP SPACE: "Tribunal" - REV. 04/06/94 - ACT THREE 27.

35 CONTINUED:	(2)

					O'BRIEN
			What matters?

					KOVAT
This trial is to demonstrate the
			futility of behavior contrary to
good order. Everyone will find it
			most uplifting.

					O'BRIEN
			Not everyone.

					KOVAT
			Once again, justice will prevail.
Our lives will be reaffirmed safe
and secure. Here on Cardassia, all
			crimes are solved. All criminals
are punished. All endings are happy.
Even the poorest of our citizens can
walk the streets in the dead of night
in perfect safety. You are only one
man, but your conviction will be a
			salutary experience for millions.
				(then)
			Now then... the trial opens
tomorrow... Do you have any questions?
Anything you want to tell me?

					O'BRIEN
Only that I am not guilty of any
crime. And that I regard this whole
			procedure with nothing but contempt.

Kovat studies O'Brien for a moment, then smiles.

					KOVAT
			Good... good... maintain that level
of arrogance in the courtroom and we
should put on a very good show indeed.

					O'BRIEN
			I do have one question.

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT THREE 28.

					SISKO
			Are they all like this?

					KIRA
All of them... there isn't a photon
			warhead left in here...

					SISKO
			How could somebody transport two
			dozen warheads off this station
			without the perimeter sensors picking
			it up...

					DAX
The metal in these crates has the
same mass as the warheads... a
			Transporter could've been programmed
			to switch the two simultaneously...
			the sensors might've been fooled.

					KIRA
				(re: O'Brien)
But it would require a transporter

					BASHIR
I know what you're implying, Major

					SISKO
				(thinking strategy)
If the warheads were in the runabout,

					DAX
If they were in the runabout, how

A long beat. All of this seems to O'Brien to be for
naught... they've got him and they've got him good... he's
past the indignity and anger and into glum acceptance...
he's a dead man. Odo now speaks with uncharacteristic
	warmth...

					ODO
Being accused of a crime is not a
disgrace, Chief. Some of the great
figures of history have shared the
			honor with you.

					O'BRIEN
I never figured on dying a martyr.

					ODO
Not all of them were martyrs. And
not all of them died. Some of them
were just innocent men. Like you.

They exchange a look of bonding.

					ODO
I've managed to get myself named to
your defense team. I'll be there
tomorrow. Your wife will be there
as well. But she won't be weeping.
And neither will you. I want the
Archon to see the clear, unwavering
eyes of an innocent man. Is that
			understood?

					O'BRIEN
			Yessir.

	Odo nods...

					ODO
			Guard!

The guard comes and turns off the forcefield...

					ODO
			I'll see you tomorrow.

					O'BRIEN
			Odo...
				(Odo pauses)
			Thanks for being here.

Odo nods and EXITS as the Guard turns the field back on.
O'Brien wants to be hopeful, but it's hard.

									FADE OUT.

	FADE IN:

39 INT. DEEP SPACE NINE - OPS (INSERT) (VPB)

Close on an Okudagram... it is a voiceprint analysis... we
hear a drastically slowed down version of O'Brien's voice
from the recording playing in the background so that O'Brien's
	voice is greatly distorted...

					DAX (V.O.)
			The voice modulation patterns don't
match up. See how the peaks here
and here are out of phase... ?

40 ANGLE - SISKO AND BASHIR LOOKING OVER DAX'S SHOULDER

	at her station...

					BASHIR
So we can prove it wasn't O'Brien
			who entered the weapons locker...

					DAX
				(acknowledges)
			It's O'Brien's voice... but the
			sentence was reconstructed sound by
			sound.

Kira arrives on the Turbolift... she thinks she has more bad
	news.

					KIRA
			I've got our Maquis.

Kira moves to them with a PADD... puts it down on Dax's
	counter...

					KIRA
I narrowed the suspects down to twelve
people who live in the Demilitarized
Zone and were on the station that
			day.

41 INSERT - THE PADD (OPTICAL)

	A picture of Boone.

41 CONTINUED:

					KIRA (V.O.)
			Raymond Boone. Human. Lives on
Volan Three. Three merchants on the
Promenade saw him talking to O'Brien
			just before he left.

	RESUME

					BASHIR
Talking to him and recording his
			voice, perhaps... ?

					KIRA
			Recording?

					DAX
				(to Kira)
			Someone doctored Chief O'Brien's
voice to get into the weapons' locker.

	That brightens Kira's outlook considerably...

					SISKO
			I'll have him picked up.

As he moves to his office...

43 EXT. CARDASSIA PRIME - MATTE SHOT (OPTICAL)

This time on the screen is Makbar... as the trial is being
shown to the populace... our angle is close enough this time
to allow us to hear --

					MAKBAR
			The offender, Miles O'Brien, human,
			officer of the Federation Starfleet,
has been found guilty of aiding and
			abetting seditious acts against the
state. The sentence is death. Let
			the trial begin.

As she bangs not a gavel but a symbolic rock...

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT FOUR 38.

44 INT. COURTROOM

Dark... multilevel but spare... no gallery per se, but there
is a suggestion of a few children watching the proceedings
from behind Makbar who is at the highest level... the
defendant's "box" is elevated to separate him from the
	others...

					MAKBAR
				(continuing)
			Conservator Kovat, is the offender
			ready to face his judgement?

					KOVAT
			He is, Madame Archon.

					MAKBAR
			Let him enter.

O'Brien moves in to the box, alone if there is only one entry
to it... or he can be led in by a guard if necessary... he
looks around taking in the environment... as he ENTERS we
can hear knuckles rapping on countertops, almost seeming
like applause, coming from the children's gallery. Makbar
	and Kovat do not rap.

					MAKBAR
Mister O'Brien, you can spare your
			family and the Federation further
			humiliation by dispensing with this
			proceeding and confessing now.

					O'BRIEN
			No thanks.

					MAKBAR
Very well. The Nestor and Mrs.
			O'Brien may enter.

From a different doorway, Odo and Keiko ENTER... Keiko is
strong, confident... more rapping... she exchanges a warm,
loving smile with her husband and proceeds to join Odo with
	Kovat at the defense position...

					MAKBAR
			Mrs. O'Brien, this court recognizes
the disgrace your husband has brought
to you. As is prescribed by the
			Cardassian Articles of Jurisprudence,
we hereby offer you the opportunity
			to dissociate yourself from his
			actions by testifying against him.

DEEP SPACE: "Tribunal" - REV. 04/08/94 - ACT FOUR 39.

44 CONTINUED:

					KEIKO
I have no intention of testifying

					MAKBAR
				(beat, observes her
				with disdain)
			Call the first witness...

					ODO
Madame Archon, may I confer privately
			with the Conservator before we
			begin...

					MAKBAR
Mister Odo, I understand you have
not served as a Nestor before...
perhaps I should explain that you
have no status to address this court.
			You advise the offender... that's
			all.

					ODO
			I beg the court's indulgence. I am
			new at this.

					MAKBAR
				(unhappy)
All of Cardassia is watching these
			proceedings... private conferences
do not make for good viewing... you
should have done this before we
			convened...
				(beat)
			Very well, make it quick.

45 ANGLE WITH THE DEFENSE

	SOTTO:

					KOVAT
Please don't ruin this for me. I'm
only a year away from retirement.

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT FOUR 40.

45 CONTINUED:

					ODO
We have new evidence to prove
			O'Brien's innocence.

					KOVAT
			New evidence?

					ODO
If O'Brien is accused of stealing
warheads from Deep Space Nine, we
can prove he didn't do it...

					KOVAT
Of course, he did it. He's been
			found guilty, hasn't he?

					ODO
			Someone manipulated a recording of
his voice to gain entry... I can
			produce that recording here...

					KOVAT
No evidence can be submitted after
the verdict has been reached... you
			should know that...

Odo does know that but he will leave no stone unturned...

					ODO
Of course... but I was hoping that
			the most reknowned conservator in
Cardassia might be able to find a
			way...

					KOVAT
				(interrupting, smart,
				with disdain)
You flatter me, sir. But, we want
justice, not chaos in our courts.
No, I will take no part in this.

					MAKBAR
Enough. Are you ready to proceed,
			Conservator?

					KOVAT
			I am.

					ODO
				(overlapping)
May I address the court, Madame

					ODO
But if our conservator refuses to
			bring up new evidence...

					MAKBAR
				(overlapping)
			Silence!

					ODO
				(continuing)
... of a manipulated recording of the
			offender's voice that would prove
			his innocence...

					MAKBAR
				(overlapping)
You are out of order, sir!

					ODO
				(continuing)
... what else am I supposed to do?

					MAKBAR
You are supposed to respect our
			judicial procedures. Wouldn't you
ask that we respect your rules if we
			were in your court?

					ODO
Which raises my next point, Madame
Archon. I would like to move for a
change of venue to my court... no
			crime was committed against
Cardassia... it was in fact committed
			at a Bajoran space station...

					KOVAT
			Madame Archon, I am extremely
humiliated. I ask to be relieved of
			this assignment.

					MAKBAR
			No. Sit down.
				(to Odo)
And you, sir -- do not try the

If this court finds you in contempt,
			you will discover the punishment

45 CONTINUED:	(4)

					MAKBAR
				(still angry)
As for new evidence, yes, I fully
expected the Federation to come up
with remarkable new evidence in an
attempt to free Mister O'Brien. I'm
sure your experts can create all
			sorts of interesting evidence to
confuse the issues. That may work

will be no new evidence considered.

	She pounds her rock.

					MAKBAR
				(continuing)
			Call the first witness.

46 INT. COMMANDER'S OFFICE

Boone sits in front of Sisko and Kira... Sisko is

					SISKO
Look, we're not after the Maquis

			innocent man...

					BOONE
			... And I'm telling you I don't have
any idea what you're talking about...

					KIRA
People saw you talking with O'Brien

					BOONE
Since when is that a crime? We're
			old friends from the Rutledge...

					SISKO
Doesn't it bother you to see an "old

			Cardassians?

					BOONE
Of course it does. I wish there

					BOONE
			I haven't done anything. I have

Sisko glances at Kira -- they're getting nowhere.

					SISKO
			Hold him for further questioning.

She escorts him out. Sisko frowns...

47 INT. OPS

			You're from the Maquis?

					MAQUIS MEMBER
			That's correct.

					BASHIR
			Why should I believe you?

					MAQUIS MEMBER

50 CLOSER ANGLE ON BASHIR

					BASHIR

Bashir turns as he suddenly realizes that he's alone.

51 ANGLE

53 INT. COURTROOM

Gul Evek is now on the stand. Near him are the crates of

					KOVAT
These Maquis are based in the

					GUL EVEK
				(acknowledges)
			They are all from Federation

					KOVAT
How do you know these photon warheads

					GUL EVEK
			According to reliable sources, the

					ODO
			I object.

					KOVAT
				(upset)

					MAKBAR
Can you provide any details, Gul

					GUL EVEK
			I'm afraid that information cannot

					MAKBAR
			That's an acceptable answer.

					SISKO
To help us answer some questions

					BOONE
			What are you talking about?

					BASHIR
For example, why you haven't spoken

					BOONE
What's that got to do with anything...
I never got along with them...

					BASHIR
That's not what they told us...

					O'BRIEN
I have nothing to say to this court.

					MAKBAR
			Under Cardassian law, you are

As the guard moves to escort him, O'Brien shrugs his arm
	away and moves ahead alone...

56 ANGLE WITH KOVAT AND ODO

The Cardassian lawyer leans in... sotto:

					KOVAT
This would be a good time for you to
			advise the offender.

					ODO
			Advise him to do what?

					KOVAT
To confess and throw himself on the
mercy of the court, of course.

					ODO
I've never heard of a Cardassian
			court showing mercy.

					KOVAT
That's not the point. Think of the

Let him use his last breath to show

Makbar throws a look at Kovat who shrugs, what can I do?

					MAKBAR
			Proceed Mister Korvat.

Kovat approaches O'Brien... with sympathy --

					KOVAT
Mister O'Brien... were you abused as
			a child...

					O'BRIEN
			What?

					KOVAT
			Were your parents especially
abusive... did you hate them very

					O'BRIEN
			I loved my parents...

					KOVAT
			I see... spousal abuse, perhaps...

			I can't help you because I'm no

					KOVAT
			Well, I tried...

					MAKBAR
Tell me, Mister O'Brien -- how many

					O'BRIEN
Killed? None... since the war, that

					MAKBAR
			Including the war, how many

					ODO
			Madame Archon, what relevance does

					MAKBAR
His past criminal record is very

					O'BRIEN

					MAKBAR
Or are you deeply prejudiced against
Cardassians... do you not in fact

					O'BRIEN
				(beat)
			I decline to answer.

					MAKBAR
There are no grounds in Cardassian

Answer the question. Is it an

					O'BRIEN
				(beat)
			It is.

					KOVAT
Madame Archon, at this time, it seems

					KOVAT
Your Honor, I apologize but it appears

					MAKBAR
No matter. You've done your usual

					MAKBAR
				(to Kovat)
			Return to your seat.

	He does, curious...

					MAKBAR
Once again the Cardassian system of

			family ties... the potential for
rehabilitation. And I'm sure he has
			gained a new appreciation for
			Cardassian law through this difficult
			process. Therefore, I am pleased,
			in the spirit of furthering
			Cardassian/Federation relations, to
hereby set aside the verdict and
			release Mister O'Brien into the
			custody of his Commander, Benjamin
			Sisko.

She hits her rock on the countertop... stands and EXITS...
O'Brien can't believe what's happened... runs to Keiko and
	embraces her...

62 AT THE DEFENSE TABLE

Odo looks back to Sisko and nods. Boone gets up and EXITS
to the rear. Kovat looks confused and worried.

					KOVAT
			What happened?

					ODO
			You won.

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT FIVE 56.

62 CONTINUED:

					KOVAT
				(terrified)
			They'll kill me.

	He EXITS after Makbar.

63 EXT. SPACE

	A Starfleet Runabout at impulse.

64 INT. RUNABOUT

Sisko is at the controls. Odo, O'Brien and Keiko are there.

					SISKO
When Doctor Bashir examined him, he
			discovered that Boone was missing
his first molar. His DNA analysis
			confirmed that he was Cardassian.

					KEIKO
			He was surgically altered... ?

					SISKO
				(acknowledges)
Eight years ago, to replace the real
Raymond Boone who was taken prisoner
			at Setlik Three... and apparently
			killed in detention.

					O'BRIEN
How did you figure it out?

					SISKO
His ex-wife told us he came back
from captivity a different man. She
blamed it on the treatment he received
from the Cardassians. But it started
			us thinking...

					O'BRIEN
So he was spying for the Cardassians
even when he was on the Rutledge
			with me...

					KEIKO
But why did they want to frame Miles?

DEEP SPACE: "Tribunal" - REV. 03/31/94 - ACT FIVE 57.

64 CONTINUED:

					ODO
This trial was never about your
			husband, Mrs. O'Brien. It was
			designed from the beginning to
			discredit the Federation. To show
that the Maquis had their official
sanction. Gul Evek made it clear in
his testimony that the situation had
			become untenable, remember?

					O'BRIEN
Next thing, they would have been
			demanding that the Federation colonies
			be disbanded.

					SISKO
Exactly. As soon as Makbar saw Boone
in the courtroom, she knew we had
the goods to embarrass the High
Command in front of the entire
			populace.

					KEIKO
I'm just glad it's all over.

					O'BRIEN
Yeah, I'm ready to get back to work.

					SISKO
Uh uh, I had to use all my influence
			to get your accommodations extended
at the lagoon... I want you to take
some time to recover from all this...
we'll drop you off on the way...

					O'BRIEN
But we don't have our bags, no holo-
			cam, nothing to read...

					KEIKO
			Perfect.

	Off O'Brien's look...

65 EXT. SPACE (OPTICAL)

As the Runabout heads for home, goes to warp.

									FADE OUT.
