EXT. HOUSE - DAY
TERESA and her partner RANDY exit the
ambulance, running toward a frantic elderly LANDLADY standing at the gated
entrance to the property.
LANDLADY
She's late with the rent and-- and she
wouldn't answer, so I figured that I'd just get some of her stuff, you know,
chuck it outside, teach her a lesson, it's right this way, oh God there's so
much blood. Right this way.
She leads them through the courtyard.
INT. APARTMENT - DAY
The landlady leads them through the door.
LANDLADY
Oh, There she is. Oh my God.
Teresa and Randy approach a woman lying on
the floor. There's blood pooled around her waist. Teresa puts her
fingers to the woman's neck.
LANDLADY
Was she shot?
TERESA
No pulse.
LANDLADY
I didn't hear anything, I was in the laundry.
Randy unpacks equipment and Teresa inspects the unconscious
woman.
Teresa picks up a syringe.
TERESA
O.D.?
LANDLADY
Oh no.
RANDY
She an addict?
LANDLADY
I didn't think so. Not anymore. She came here from the
clean living center. I like to help people starting over.
Teresa looks at the woman's groin.
TERESA
Wait a minute.
LANDLADY
Was she shot? Stabbed?
Teresa and Randy finally begin administering CPR.
TERESA
You notice anything about Janice, say, the last eight or
nine months?
LANDLADY
Oh God, I completely forgot.
TERESA
She gave birth less than 20 minutes ago.
RANDY
Here? But where's the baby.
TERESA
That's a good question.
MAIN TITLES
ACT I
INTERTITLE: DAVID McNORRIS
INT. DINER - DAY
Joel and David face each other on opposite sides of a booth.
JOEL
Son of a bitch.
DAVID
Come on, you can do a whole lot better than that.
JOEL
I'm in public, I can't. When is it goin' down?
DAVID
I don't know.
JOEL
You said you needed to meet with me this morning.
DAVID
Look, uh, I'm gettin' on a flight in a couple of hours. I
don't know when I'll be back. They say 30 days. I'm goin' to the desert,
there's this little spa named after a former first lady.
JOEL
Rehab. Why you givin' me this heads up?
DAVID
I don't know. I don't know much about anything any more. I
don't know if I'll have a job waiting for me when I come back. I don't even
know if I want to come back. I just figured telling you was the right thing to
do.
Joel's cell phone RINGS.
JOEL
Sorry, it's my partner.
He answers.
JOEL
Fearless. Yeah. Right, I'm on my way.
He hangs up.
JOEL
I have to go. It's a, uh, missing baby.
DAVID
Go find him.
Joel starts to leave.
DAVID
Hey, Joel? uh, good luck.
JOEL
Good luck, David.
They shake hands. Joel leaves.
EXT. HOUSE - DAY
INTERTITLE: FEARLESS
Paramedics wheel the woman out on a stretcher.
TERESA
They found this next to the body.
Teresa hands a large plastic tube containing the syringe to
Fearless.
FEARLESS
So what's your guess, heroin?
TERESA
Something with a hell of a kick. We barely pulled her out
of it.
FEARLESS
But you did pull her out it. Nice work.
TERESA
Thanks.
Tom and Ray descend the steps behind Fearless.
TOM
God there must have been fifteen, twenty cats in there.
RAY
We canvassed that floor. Nada.
Joel, off screen, begins to speak. The camera pans to him.
JOEL
There's a dumpster out back. Why don't you guys check it
out?
Off Ray's look.
JOEL
Unless there's a problem.
RAY
Problem? No, no, just identifying a pattern. You know,
whenever we catch one of you detective's cases we end of ass-deep in the
dumpster. If my powers of recall don't fail me.
JOEL
I'll check the dumpsters, Ray.
TOM
Ah, no, we'll do it.
Tom and Ray head off. Fearless and Joel walk and talk.
FEARLESS
Why don't you go home partner? See your lawyer. We got
this.
JOEL
Nah, can't let on that I know. Just gotta wait for it to
come down. Besides doin' a job's the only thing that'll keep my mind off it.
Says here in her date planner that she had a doctor's appointment at the Union
Family Clinic.
FEARLESS
Right, right, I know that one, mostly women on medicare.
What else she write there?
JOEL
It just says 'Dr. D'
INT. CLINIC - DAY
Joel and Fearless speak to DR. PAMELA DUNKIN. As they talk
the Doctor meets and greets patients in the clinic waiting area. (Seemingly
unprofessional, talking about one patient with the police as you roam the
waiting area.)
DOCTOR
Janice was coming every week, being nine months pregnant.
She's conscientious about her health and the health of her baby.
JOEL
You know she was using?
DOCTOR
What? No.
JOEL
Looks like she shot up and gave birth.
DOCTOR
Gave birth?
JOEL
Yeah, and her baby's gone.
DOCTOR
You can't be serious.
FEARLESS
Well, an empty syringe was found beside her body.
DOCTOR
So where's the baby?
JOEL
We're trying to find it. You saw her this morning. She
show any signs of going into labor, any problems, contractions, anything?
DOCTOR
No, she was two weeks away. Janice was fine this morning.
Not a hint of labor. She was so excited about her baby coming into the world.
FEARLESS
So why do you think she started using again?
DOCTOR
I don't know.
DOCTOR
So do you think she abandoned the baby?
JOEL
No.
DOCTOR
Someone took the baby?
FEARLESS
So who's the father?
DOCTOR
I don't know, she didn't talk too much about him. He's an
addict, still using, they're not together.
JOEL
You got a name?
DOCTOR
I'm sure he's in Janice's file. Do you think he took the
baby?
FEARLESS
Well, we don't really think anything yet.
DOCTOR
I hope not. Because as addicts go, and what little Janice's
told me about him, he's a piece of work.
(to receptionist)
Can I have Janice's file?
INT. POLICE INTERROGATION ROOM - DAY
Joel and Fearless interrogate the father.
GUY
Yeah, I knew she was knocked up. Sure. I keep track of my
seed, man.
FEARLESS
So, were you with Janice this morning?
GUY
No, I was fertilizing elsewhere. No, but you know, she
called me on the cell, but that was weird.
JOEL
What did Janice say when she called you?
GUY
She was alone, you know, doin' the labor thing. Waah,
waaah. She was lookin for some relief.
FEARLESS
So she called you, her dealer.
GUY
Hey, I'm outta that life. You know, I told her, but she
was-- she was lookin for an armload of Mexican mud, though.
FEARLESS
And you delivered it to her.
GUY
That-- all right, that's when she offered me the kid.
Fearless and Joel look surprised.
JOEL
She offered you the baby?
GUY
Yeah, it was like-- like an exchange thing, you know, she
give me the baby, I give her the dope. Not exactly mother-of-the-year
material. So, you know, I just clicked off the cell and just went back to work
on Wilma.
FEARLESS
I think you took that baby.
GUY
Hey, what? I'm a-- I'm a baby guy now. I mean, come on
man, I didn't even see the thing, much less want it, what are you kidding me?
Yo, maybe the next dealer on her speed dial did, all right? Maybe he was some
guy with Daddy fever or something.
Supervisor opens the door and looks in.
SUPERVISOR
Joel. My office.
Joel looks at Fearless and gets up.
GUY
Ooh, you gotta stay after school. You in trouble.
INT. POLICE OFFICES - DAY
Joel follows the supervisor to his office. Fearless lags
behind.
Ray and Tom approach Fearless.
RAY
So you think junkie boy has that baby?
FEARLESS
I don't know, he says he doesn't.
Tom notices Interal Affairs agent RICH TRUMPER across the
way.
TOM
What's Trumper doin' here?
RAY
Better call my union rep.
FEARLESS
He's not here for you, Ray.
INT. POLICE RESTROOM - DAY
Trumper flushes the urinal and heads to the sink to wash his
hands.
Fearless, Ray and Tom enter behind him.
FEARLESS
You got yourself some little balls there Trumper.
TRUMPER
Hello Bobby.
RAY
What are you doin here Trumper if you're not here for me?
TRUMPER
Oh, I'm sure it will be you again soon, Ray.
He looks at Joel.
TRUMPER
You haven't told him?
FEARLESS
He's goin' after Joel.
RAY
For what? Forgetting to say Bless You when somebody
sneezes?
FEARLESS
Trumper reopened the investigation into Joel's baby's death.
RAY
Now I'm reminded why you're so universally loathed around
here, Trumper.
TRUMPER
Yeah.
As Trumper tries to leave, Tom lays a hand on his shoulder.
TOM
I don't know how you sleep at night.
TRUMPER
This is, this is touching. This, this loyalty. I'll note
it in your files. Oh, and by all means, you go on judging me and my investigation,
just make sure you don't look too closely at the facts.
FEARLESS
Facts? What facts? A man's baby dies. You want to bring
all that up again.
TRUMPER
Was the death natural?
FEARLESS
You trying to imply that the man killed his own child?
TRUMPER
I'm not implying anything.
FEARLESS
Why don't you read the coroner's report?
TRUMPER
I would love to read the coroner's report, detective. I
truly would. Trouble is, it's missing.
Fearless looks at him, evidently surprised.
INT. POLICE ROOM, FEARLESS'S DESK - DAY
Fearless looks at the papers at his desk. He looks up as
Tom approaches.
TOM
Hey, Joel.
We see now that Joel is seated at his desk too, across from
Fearless.
Joel stands, looks at Tom, and walks away.
TOM
You got a minute?
Tom comes close to Joel to talk to him,
TOM
I know things haven't been exactly square with us, but I
just heard about Trumper, and uh I wanted to let you know if there's anything
I can do, I want to help.
JOEL
Thank you.
Fearless comes over and stands nearby, listening.
TOM
For what it's worth, I got a friend down at the M.E.'s, said
Trumper's been spending a lot of time down there, um, you don't have any idea
what he's looking for in that missing file?
JOEL
My baby's second autopsy report.
TOM
Yeah, but why? What's in it?
JOEL
Don't know. I haven't read it.
TOM
All right, um, Well, like I said, if there's anything I can
do, let me know.
JOEL
Thanks.
Tom leaves. Joel looks at Fearless, Fearless looks at
Joel. They both know something.
INTERTITLE: TRUMPER
EXT. PARKING LOT, TRUMPER'S CAR - NIGHT
Trumper is seated in his car in a vacant parking area. A
second black car with California plates pulls up next to him. We hear a car
door open and close.
The other driver gets out and walks over. We see only his
sneakers until he gets into Trumper's car.
It's TOM.
TRUMPER
Did you get him?
Tom hands him a recording device.
TOM
Yeah, oh yeah, it's definitely Joel.
ACT II
INTERTITLE: TOM, 2 DAYS EARLIER
INT. DINER - DAY
Tom is eating at the counter. His phone RINGS. He answers.
TOM
Hello. Yeah? What do you want, Trumper? Why? Okay, how
about I talk to my union rep and I get back to you. Okay, then what is it?
EXT. DESERTED PLAZA - DAY
Trumper is standing by a railing as Tom approaches.
TRUMPER
Hello, Tom.
TOM
Trumper, today is my day off, so if you have something
important to tell me, I'd appreciate it if you cut to the chase.
TRUMPER
All right. I.A.'s been watching you, Tom.
TOM
Aah, that's great. You said on the phone I wasn't under
investigation.
TRUMPER
You're not. I.A. has a recruiting program. We're always
looking for fresh talent.
TOM
Talent for what?
TRUMPER
Promotion. D1 status.
TOM
Wait a minute. You're offering me detective?
TRUMPER
We're offering you a shot. Or you can stay in your
division. Maybe you get noticed. Maybe not. Or you can try the way that most
cops don't even consider.
TOM
Yeah, well, you know there's a reason why cops don't
consider Internal Affairs.
TRUMPER
Yeah, yeah, it makes you a rat, right? According to your
brothers in blue.
TOM
Look Trumper, I don't know what it is I'm here for, but can
you tell me why me and why now?
TRUMPER
You mean, besides Vanzani and the death of three cops? Your
station is under close scrutiny, Tom. We did a computer search of all police
reports in the last three years looking for names from your station. A few
popped up, all minor, then there was an interesting one.
Trumper hands Tom a file. We see the tab on the folder. It
says "STEVENS, JOEL"
TOM
So this is why me.
FLASHBACK - CLOSED OFFICE AT POLICE STATION - DAY
JOEL and TOM speak in a room. Tom is seated behind the desk
as Joel paces. Trumper observes, from the back of the room, quietly.
JOEL
Anything is a possibility tonight.
TOM
No Joel, that's where you're wrong, but you need to confirm
your opinion of me.
JOEL
What's that?
TOM
Next question.
CUT BACK TO TRUMPER AND TOM:
TRUMPER
Does it help, your dislike for Stevens? Yes.
TOM
What if I say no?
TRUMPER
Then I'll look for somebody else. And the next time we
meet, it won't be to talk about promotion.
Trumper walks away.
FLASHBACK TO:
Tom talks privately to Joel.
TOM
What do you think he's looking for in that missing file?
JOEL
My baby's second autopsy report.
TOM
Yeah, but why? What's in it?
CUT TO:
EXT. PARKING LOT - NIGHT
Trumper plays the recording of Tom and Joel's conversation.
JOEL
I don't know. I haven't read it.
TOM
All right, like I said, if there's anything I can do, let me
know.
Trumper stops the recorder.
TRUMPER
That's it? Not much of a confession.
TOM
Give me time. I'll get him.
INTERTITLE: JOEL
INT. HOSPITAL ROOM - DAY
Joel and Fearless speak to the woman (Janice)
JANICE
You police? Why do you want to talk to me?
FEARLESS
Just want to ask you a few questions, ma'am.
JANICE
Where's my baby? Nobody will tell me. Did something
happen?
JOEL
That's what we're trying to find out. Why don't we start
with you telling us what happened yesterday. Your landlady said she found you
unconscious.
JANICE
She did?
FEARLESS
Yeah. So you were in your apartment, and we figured that
maybe you went into labor, and the pain was greater than you anticipated, so
you just went for what you knew would work. Someone brought you some dope and
you shot up.
JANICE
No, no, I haven't touched a needle in a year.
JOEL
We found a needle right next to your body, Janice.
JANICE
I don't-- I don't remember. I-- I went to the clinic, and
then I went to the store, and I came home, and-- I didn't shoot up, I couldn't
have, cause-- please you have to tell me, where's my baby?
FEARLESS
You know, we don't know, ma'am.
JOEL
We're trying to find it.
JANICE
Her! My baby is a her. This baby-- this baby-- this
baby-- she trusted me with her life. And I've been doin' so good, cause she's
countin' on me. You know, she picked me of all the people in the world. I
swear to you, I don't know what happened, but you have to find her, 'cause I
would rather be dead if you don't.
INT. HOSPITAL CORRIDOR - DAY
Joel and Fearless are leaving after visiting Janice.
FEARLESS
So what do you think about that woman, man?
JOEL
Think she's tellin' the truth.
FEARLESS
Somebody just happened to know she was givin' birth, knocked
her out, fixed her up, took the baby.
JOEL
I gotta cut out, I gotta go see a lawyer. I'll give you a
call later.
INT. COUNSELOR'S OFFICE - DAY
Joel speaks with the counselor, Dr. HERSCH, from the case
with the guy who thought he was a dog.
DR. HERSCH
You know detective, I'm primarily a shrink. My legal
practice is mostly pro bono for psyche cases.
JOEL
I know, David McNorris recommended you. He said that you're
one of the best defense lawyers in town.
DR. HERSCH
David McNorris said that. I thought he hated me.
JOEL
He said that too.
DR. HERSCH
Uh huh. Look, I don't know if I can help you. Let's see,
you said on the phone that internal affairs is after you. Why?
JOEL
My wife and I lost a baby last year. It was... a
nightmare. Sudden infant death syndrome.
DR. HERSCH
SIDS. I'm sorry.
JOEL
According to the preliminary autopsy.
DR. HERSCH
Preliminary autopsy?
JOEL
I ordered a second autopsy just to be sure. It came two
weeks later, and by that time, I had a wife with slashed wrists, So I never
read it, and now the coroner's file's gone missing.
DR. HERSCH
And they think you have it. Okay, let's back up. You said
your wife tried to kill herself?
Does she know this case has been reopened?
JOEL
No.
DR. HERSCH
And you're not going to tell her?
JOEL
Not if I don't have to.
DR. HERSCH
Because you don't think she can handle it? Or you think she
might try to kill herself again?
Joel just looks at him and doesn't respond.
INT. JOEL'S CAR - NIGHT
Joel is driving home. He approaches his house and sees
police cars everywhere.
JOEL (quietly to self)
Oh God.
He pulls up in his driveway and gets out and runs inside.
INT. JOEL'S HOUSE - NIGHT
Police are combing through files at his desk, executing a
search.
POLICEMAN (O.S., outside)
Detective, I need you to wait here a minute.
Joel pushes his way through the door.
JOEL
Get out of the way. Where's my wife? Kelly!
KELLY
Joel? What is going on?
They embrace. After a moment, they separate and Joel looks
over at Trumper on the phone in his dining room.
KELLY
Joel? What is all this? What?
ACT III
INT. COUNSELOR'S OFFICE - DAY
Joel and Kelly enter the Dr. Hersch's office.
DR. HERSCH
Did they search anywhere else?
JOEL
Yeah, my locker.
DR. HERSCH
Have a seat. You have the missing file, detective?
JOEL
No, I don't.
DR. HERSCH
Do you have the missing file, detective?
JOEL
No, I don't.
DR. HERSCH
Sure you do.
JOEL
Is this like one of your shrink tricks? Try to get me
worked up?
DR. HERSCH
No, this is a lawyer trick. This is the kind of questions
you're going to get from IA.
But if you want my shrink side, you can have it. How do you
feel about what's going on?
JOEL
Let's stick with the lawyer side, okay?
DR. HERSCH
Okay. Mrs. Stevens, why did you try to kill yourself?
JOEL
Don't, don't, stop. Leave her out of this. She shouldn't
even be here.
KELLY
Joel--
JOEL
No, no, Kelly, this is about me. They're after me, they're
not after you. Okay. I want you to leave Kelly out of this.
DR. HERSCH
I can try. But I can't control everything.
JOEL
Well, keep Trumper away from her.
DR. HERSCH
It's not just Kelly he's gonna want to talk to.
INTERTITLE: TERESA
INT. OFFICE, POLICE STATION - DAY
Trumper is speaking with Teresa.
TRUMPER
You made a call to Detective Stevens home at 5:30.
TERESA
Are you asking me, you know, the answer that I told you,
like, ten times.
TRUMPER
Eleven's my lucky number.
TERESA
We got a call at 5:30 that a woman had been cut walking
through a shower door.
TRUMPER
That's what Detective Stevens said.
TERESA
At the scene, I found Mrs. Stevens bleeding.
TRUMPER
From the wrists. Did it look like she walked through a
shower door.
TERESA
The door was broken.
TRUMPER
The injuries were self-inflicted.
TERESA
That's speculation.
TRUMPER
Speculation. You watch too many law shows. So, Detective
Stevens lied then he broke the door to cover up his lie. What happened next?
TERESA
We stopped the bleeding, drove her to the ER, they patched
her up.
TRUMPER
What did Mrs. Stevens say as you were assisting her.
Nothing specific.
TERESA
She was crying.
TRUMPER
And what did she say when she was crying?
TERESA
What do you say when you cry detective?
TRUMPER
We spoke to your partner Randy earlier, did you know that?
And he said Mrs. Stevens kept repeating the same thing that night over and over
again.
EXT. AMBULANCE BAY - NIGHT (FLASHBACK)
Teresa and Randy along with Joel push Kelly on a stretcher
up the ramp to the emergency room entrance.
KELLY
Oh my God, My baby-- I killed her. I killed her, I killed
my baby.
INT. OFFICE, POLICE STATION - CONT'D
TRUMPER
You know, I uh, I don't enjoy this Miss Ortiz. In this
instance, I'm here to protect those who can't protect themselves, like an
innocent child. You understand?
TERESA
Um hm.
TRUMPER
So what did Mrs. Stevens say that night?
TERESA
Nothing.
EXT. STREET - DAY
Fearless talks on the phone by the curb. Teresa walks with
Joel toward the street.
TERESA
He's playing the Susan Smith angle.
JOEL
(sigh) You gotta be kiddin' me.
TERESA
I'm sorry.
JOEL
Oh, don't be sorry.
TERESA
I tried.
JOEL
I know. She said that-- you know, she didn't mean it.
TERESA
I know. I know about grief, Joel, and almost anyone who
loses a child no matter how it happens they feel responsible.
JOEL
She didn't mean it.
TERESA
I don't judge people, I just try to help them. I just wish
to God that I could help you.
FEARLESS
Hey! You're right, partner. Janice did not shoot up with
Heroin. Now, she did overdose on barbituates. Taken orally with some kind of
fruit drink. They were in her system a couple-a hours before she passed out.
JOEL
What about the needle, if it wasn't heroin? What was it?
FEARLESS
Pitosin.
TERESA
Pitosin? That's a labor-inducing drug.
FEARLESS
Yeah, that's what they said. I think we should have another
talk with that boyfriend of hers.
JOEL
All right.
INTERTITLE: JOEL
EXT. SKATEBOARDING SPOT IN PARK - DAY
Joel and Fearless approach GUY seated on a bench.
FEARLESS
Hey, Johnny. What's up, man?
JOHNNY
Do I know you, man?
Johnny suddenly tries to get up. Fearless and Joel grab him
and seat him back down.
JOEL
Sit down.
JOHNNY
Come on man.
FEARLESS
You know exactly what we want, man.
JOHNNY
I didn't take no baby, I told you that.
FEARLESS
We know you lied about Janice calling you to buy some dope.
If you don't tell us why you lied, man, we're gonna take you straight to jail and
stick you in your own concrete bedroom.
JOHNNY
I-- It wasn't my idea, okay. She told me to do it.
JOEL
Who told you to?
FEARLESS
Who told you to?
JOHNNY
They paid me with pharmaceutical grade, man. This junk is
hot, makes China look like crap.
Joel grabs his mouth to talk directly to his face.
JOEL
We're trying to find a baby. Who told you to lie?
JOHNNY
Okay, the doctor lady, man, in the clinic. Okay?
Joel and Fearless leave.
EXT. DOCTOR'S HOUSE - DAY
A delivery man rings the doorbell. There's a delivery truck
in the driveway.
The doctor opens the door cautiously, with the chain still
on.
RAY
Hi, I got a delivery for a Doctor Pamela Dunkin.
DOCTOR
You can just leave it outside.
RAY
No, I can't, ma'am. It's perishable. It's something from
one of those fruit club things.
DOCTOR
Just a second.
She closes and door and reopens it with the chain off.
As she opens it, we see Ray pointing his gun at her.
RAY
LAPD, Don't move!
The doctor flees inside.
RAY
Freeze! Freeze!
As we rush inside, we see a young couple looking at a baby
in a bassinet.
RAY
Put your hands up!
The doctor runs toward the sliding glass doors, but Fearless
is entering there, gun drawn.
The doctor runs down the steps to the lower floor, but Joel
is coming up from there.
JOEL
Stop right there. Turn around, put your hands on your
head. Turn around. Hands on your head.
The doctor reluctantly complies.
JOEL
Interlock your fingers. All right, let's go.
CROSSCUT TO:
INT. DOCTOR'S HOUSE - MOMENTS LATER
Police are leading the doctor and the young couple out in
handcuffs. Ray picks up the baby, which is in a laundry basket and carries her
outside.
RAY
There we go. Little dream girl. What do you see, eh? What
do you see? Probably don't even got the focus thing down yet. That's all
right. It'll come.
JOEL
How's she doin?
RAY
Oh, she's fine. Children services is on their way.
Ray's phone RINGS. He answers.
RAY
Hello. Thomas! Thomas! Yeah, you missed a good one. my
first arrest ever wearing short pants. A little breezy. Oh yeah, hang on.
Ray holds out the phone to Joel.
RAY
It's Tom. He wants to talk to you.
Joel takes the phone.
JOEL
Hello? Yeah. Where? All right.
He hangs up and hands the phone back to Ray.
JOEL
Thank you.
He rushes inside just as Fearless comes out.
JOEL
I gotta go. Kelly's in with Trumper.
INTERTITLE: KELLY
INT. POLICE ROOM - DAY
Kelly speaks to Trumper.
KELLY
You are such a coward. Going after my husband like this.
TRUMPER
It's not a witch hunt, Mrs. Stevens.
KELLY
That is exactly what it is. You actually think that I'd
come here voluntarily to help you build a case against him.
TRUMPER
Honestly, it always goes more quickly if I ask the

KELLY
I don't want this to go quickly. You want me to talk about
Joel. You're going to have to drag me into court in leg irons. But here is
what I will talk about. Me. Our baby's death was my fault. I had post-partum
depression. The baby had colic, I wasn't sleeping well, so I took a sleeping
pill. I slept right through my child taking her last breath. One room away
and I was sleeping. That is my fault. And I will live with that for the rest
of my life, how I failed that little girl, how I failed my husband. Now, what
I want to know is how do you justify what you have done?
TRUMPER
I don't have to. I'm upholding the law. And I may be the
only one who is, since the coroner's report on your child has suddenly gone
missing.
KELLY
My husband has done nothing except take care of me, my son
and prop me up better than any human being deserves, so you wanna mess with me,
go ahead, but you mess with him, you better sleep with one eye open.
TRUMPER
Are you threatening me?
KELLY
Make a note of it in the file.
JOEL
Kelly!
FEARLESS
Joel, be cool.
JOEL
Don't say another word, come on.
INT. OUTSIDE TRUMPER'S OFFICE - CONTINUOUS
They all exit Trumper's office.
FEARLESS
How dare you, going after a man's wife!
TRUMPER
She came to me detective.
JOEL
Talk to my wife without a lawyer?
TRUMPER
Your wife's an adult, Stevens. She knew what she was
doing. You don't have to control every move she makes.
Trumper starts to walk away and Joel grabs him by the
shoulder and pulls him back.
Fearless intervenes.
FEARLESS
Joel! Joel! Joel! Come on, it's not worth it, come on.
INTERTITLE: JOEL
INT. POLICE INTERROGATION ROOM - DAY
Joel and Fearless interrogate the doctor.
JOEL
So you arrange for people to buy babies?
DOCTOR
I arrange for people who want to have children to make a
deal with people who don't want to have children. People, women, like junkies.
JOEL
You offered this deal to Janice Edwards, but she didn't want
to do it. She wanted to keep her baby, right? So what did you do? You gave
her pitosin, you induce labor, and you take her baby away from her.
DOCTOR
I rescued it.
JOEL
Oh, you rescued it.
DOCTOR
I gave an innocent child a chance, a chance at a good life.
JOEL
What gives you the right to make that decision, what gives
you the right to take a baby away from its mother?
DOCTOR
Okay, I want to hear this, how that precious little baby
girl is gonna be better off with a welfare mom who may or may not stay off the
spike, than she would with a couple who want nothing more than to give her a
good home and the best opportunities.
JOEL
Right, and only your rich friends can provide that, huh?
DOCTOR
I had a woman come into the clinic, a crackhead, swore she
was off the pipe for a year, she had the baby, everything's fine, and then she
decides to celebrate, went on an eight-day binge, and do you know the
punchline? The baby died. But get this, she never left the apartment. Her
baby was ten feet away from her in the next room taking her last breath and she
had no idea. They called it an accident. I call it criminal neglect.
JOEL
It's not just crack babies who die from SIDS doctor.
DOCTOR
I know that, but you come to my clinic, detective, you see
what I--
Fearless enters through the door.
FEARLESS
He's here.
JOEL
Sit tight.
Joel steps out.
INT. POLICE AREA - CONTINUOUS
Joel speaks to Tom.
JOEL
Hey, Tom. I just want to thank you for giving me the heads
up about Trumper talking with Kelly.
Fearless, Joel and Tom walk and talk.
TOM
Yeah, no problem.
JOEL
Yeah, I sure am lucky you just happened to be right there at
the Parker center right there at that very moment.
TOM
Yeah, just happened to be there.
JOEL
Yeah.
TOM
I know.
JOEL
Yeah, imagine that.
Fearless puts his arm around Tom, and Joel and Fearless
steer his down the corridor.
JOEL
We're goin' this way.
TOM
What's up.
FEARLESS
Someone came by to pay a visit, shed a little bit of light
on things. Man, it's very interesting, I think you might want to hear this.
Right here in the locker room.
TOM
Right in here?
JOEL
Yeah.
INT. LOCKER ROOM - CONTINUOUS
Joel, Fearless and Tom enter the locker room.
TOM
Hey, what are you doin' here?
We suddenly see that Tom's father is there.
Tom's father approaches him, swinging fists in a playful
manner. They play box.
FATHER
Aah. Ooh, ooh, ooh, ohh. Since when does Dad need a reason
to visit his son on the job? I heard this morning about the heads-up you gave
Joel about his wife talking to that sleaze IA. Hey, what have you been working
out? You're soft here. Not you're flatter.
Tom's father feels Tom's chest area, seemingly checking for
a wire.
TOM
I'm not. Same as always.
FATHER
You know, it's a good thing, what you did for Joel. Friends
need friends to look out after them. And all those years, the IA was crawling
up my back, after awhile I got to know those guys, and by the end, they were
taking care of me. Did you know that?
TOM
No, no, I didn't know that.
FATHER
Oh, yeah, they would call me when something new was going
down. Sure you haven't been working out? Your chest is getter bigger?
TOM
You goin' funny on me, Pop?
FATHER
Funny? Take your jacket off.
TOM
You wanna ask me something, Pop.
FEARLESS
Why don't you take your jacket off, Tom?
FATHER
You know one of those guys in the IA who used to take care
of me. He called me this morning. He said, Paul, you're not gonna believe
this. You know who Trumper's snitch is? And then he told me. I don't believe
it. No way.
TOM
If you want to know something, Pop, all you gotta do is ask.
Tom holds out a recorder to his father.
ACT IV
INT. LOCKER ROOM _ DAY
Tom takes the recorder back from his father.
FATHER
You stinking snitch. This is the way you pay me back. By
working with the IA, huh?
He pushes Tom into the locker. Joel pulls him back.
Paul punches a locker.
TOM
You finished?
FATHER
Yeah. I'm finished. I'm finished with you.
JOEL
Tom, I'd like a word.
TOM
Maybe some other time, Joel.
FEARLESS
Come on, Tom, you owe him a word. You at least owe the man
that.
TOM
No I don't owe him anything. But if he has something to
say, go ahead and say it.
JOEL
I do. Alone.
Fearless and Paul step out of the room.
JOEL
Mind if I pat you down.
TOM
Knock yourself out.
JOEL
Make sure you don't have a second device. I know you have
the file, Tom.
TOM
I don't know what you're talking about.
JOEL
The coroner's file with my baby's second autopsy in it. I
know you have it.
FLASHBACK - INT. JOEL'S HOUSE - NIGHT
Trumper is sitting down at the dining room table again, on
his cell phone, looking back at Joel.
JOEL (V.O.)
While they were searching my house, I slipped away, and I
came here.
We see Joel heading quickly down the police corridor.
JOEL (V.O.)
I saw you coming out of the locker room. Told me they were
about to search my locker.
As he reaches the locker room door, he runs into Tom
exiting.
TOM
Joel, IA's in there searching your locker.
CUT BACK TO JOEL AND TOM IN LOCKER ROOM - PRESENT
JOEL
You figured out I had the file inside my locker. You got to
it before they did. Where is it?
Joel punches the locker.
JOEL
Where's the file?
TOM
It's in Trumper's office.
JOEL
You already gave it to him?
TOM
In a manner of speaking.
INTERTITLE: TOM
EXT. JOEL'S HOUSE - NIGHT (FLASHBACK)
Police cars with lights flashing are everywhere. Joel pulls
up.
Parked nearby, Tom watches as Joel rushes inside. Tom
starts his car and pulls away.
INT. LOCKER ROOM - NIGHT (FLASHBACK)
Tom breaks the lock on Joel's locker.
He searches in the locker and finds the report cached
between two shelves.
He takes the report, puts a different lock on Joel's locker
and leaves.
IA enters and approaches the locker with a bolt cutter.
IA AGENT
Is this the one?
FEMALE IA AGENT
Yes, this is it. Open it.
Tom, on the other side of the locker room, unseen, slides
the rerport inside his jacket.
On his way out, he runs into Joel on his way in.
TOM
Hey, Joel, IA's in there right now searching your locker,
man.
Tom leaves.
INT. IA OFFICE AREA (PARKER CENTER) - DAY
Tom enters Trumper's empty office quietly. He picks the
lock on Trumper's desk, slides the file into the back of the file drawer, then
closes the drawer and wipes it clean.
Tom exits Trumper's office, just as Kelly enters the nearby
door with Trumper.
TRUMPER
Right around here.
Trumper leads Kelly into his office.
TRUMPER
Morning Terry, Marsha.
Trumper enters his office.
Tom, off to the side, calls Joel on his cell phone. (Why
would he call Ray?)
TOM
Hey Ray, it's me. Is Joel there? Joel, I need to talk to
Joel right away.
CROSSFADE TO WHITE
INT. OUTSIDE TRUMPER'S OFFICE - DAY
Joel and Kelly are exiting Trumper's office
TRUMPER
Your wife's an adult Stevens. She knew what she was doing.
You don't control every move she makes.
Joel attacks Trumper, but Fearless intervenes.
FEARLESS
Joel! Joel! Joel! Come on, it's not worth it. It's not
worth it, man. Come on.
Fearless leads Joel away.
TOM
Trumper
TRUMPER
What are you doin' here?
TOM
I need a minute.
TRUMPER
You shouldn't have come here.
TOM
I just need a minute.
They go in Trumper's office.
TRUMPER
Please tell me you got some good tape on Stevens.
TOM
No, what I got is something even better.
TRUMPER
Yeah, what?
TOM
I found the file.
TRUMPER
What? You did? Where is it?
TOM
It's still in your desk, where you put it.
TRUMPER
Funny, no seriously, have you got it?
TOM
No, I am, I'm serious, it's in your desk. Go ahead, open
you drawer, have a look.
Trumper opens his desk drawer and finds the file inside.
TRUMPER
This is the file!
TOM
Oh, come on Trumper, don't act dumb.
TRUMPER
What do you mean?
TOM
Oh, is that how it works in IA? You remove a file, then you
accuse a cop of taking it?
TRUMPER
What?!
TOM
Come on Trumper, that's pretty sleazy, I can't believe you'd
do that, I mean, even for you, it's pretty low.
TRUMPER
You think you can frame me?
TOM
I have no idea what you're talking about.
TRUMPER
You're still wearing your wire, aren't you?
TOM
Well yeah.
TRUMPER
You're recording all this.
TOM
Right, exactly as you told me to. I also put a call in to
the inspector general.
TRUMPER
You think you're smart? You think you're clever? You just
made the stupidest mistake of your pathetic little life. When did you think
this up, genius?
TOM
When did I decide to do this? Well, the second you asked me
to. You know, what's bad blood between Stevens and I, is between us, and it's
on the inside. Trumper, you're on the outside. How's it feel?
INT. POLICE LOCKER ROOM - DAY
Joel and Tom are still talking.
JOEL
You plan it from the moment he asked you?
Tom smiles.
JOEL
Why didn't you say something?
TOM
Cause I didn't know if I'd get away with it.
JOEL
You saved my ass Tom. You know if they found that file in
my locker that would have been the end of me.
TOM
Well, I didn't do it for you, Joel. I just did it.
JOEL
Yeah. I'm sure your old man will appreciate it. Well, word
of what you did is gonna spread pretty quick. You'll never have to buy
yourself a drink in a cop bar again.
TOM
Yeah, my life's ambition.
Joel starts to walk off.
TOM
Joel, you know that file I put in Trumper's office wasn't
quite complete.
Tom pulls a manilla folder out of his locker. Joel
approaches him,
JOEL
What's that?
TOM
The second autopsy report.
Tom gives it to Joel.
EXT. TOM'S FATHER (PAUL)'S HOUSE - NIGHT
Tom approaches his father, who is carrying groceries from
the car insisde.
TOM
Hey, Pop.
PAUL
What are you looking for? An apology?
TOM
No, I didn't mean to cause you any embarassment today. I
just couldn't tell anybody, so I'm sorry. That's it.
PAUL
You know, don't think you're some kind of hero. Screwing
with Trumper was a bonehead play. You could have ruined your career.
TOM
So what?
PAUL
So What?
TOM
Yeah so what? I don't have a family to support, Dad. I
don't have two kids. I'm not a cop anymore, so what. I'll manage, I'll move
on.
PAUL
Well, what would you do?
TOM
Um, I don't know. Maybe I'll take up yoga. Yeah, that's
what I'll do. I'll teach yoga from now on. You see what kind of women are
into yoga these days.
PAUL
Oh yeah, legs to here.
(Paul gestures to his neck)
PAUL
I would have loved to have seen their faces. Hey, why'd you
do it?
TOM
Because I could.
PAUL
A regular Clint Eastwood.
TOM
Dad, you need a hand with that?
PAUL
Nah
TOM
You sure?
PAUL
No.
TOM
All right, good night.
PAUL
Good night.
INT. COUNSELOR'S OFFICE - DAY
Joel and Kelly speak to Dr. Hersch
DR. HERSCH
You had the file the whole time? Why?
JOEL
Because it had this. It's our daughter's second autopsy
report.
DR. HERSCH
What's it say?
JOEL
I don't know. I haven't read it.
DR. HERSCH
Why haven't you read it?
KELLY
Because he's afraid I killed our baby.
JOEL
Kelly--
KELLY
It's the truth.
JOEL
No, it's not.
KELLY
I told you about the sleeping pill I took the night our baby
died. I didn't tell you about one other time I took one of those pills. It
was when Willy was a baby. I had post partum depression then too, and I wasn't
sleeping, and so I was prescribed these pills.
JOEL
Kelly, You don't have to do this, okay--
KELLY
Yes, I do, Joel. See what I didn't know was that some
people at some times have bad reactions to these pills. One night eight years
ago, I had a bad reaction. I got up without waking up, went to our kitchen,
turned on the stove, and stuck my hand in the flame, and I left it there. Joel
found me before it got too bad, and I promised him I'd never take a sleeping
pill again. But I did take one. Last year. I was so desperate for sleep, it
was so long since that bad reaction, I just thought-- So, when I woke up and
our baby was dead, I had to face the simple, horrible possibility maybe I did
something and I didn't know it. And I've lived with that possibility ever since.
And so has Joel.
JOEL
Kelly--
KELLY
You're a cop, Joel. You wondered.
JOEL
No, I didn't.
KELLY
You know I took that pill. When I went to look for the
bottle the next day, it was in the trash. YOu had already thrown it out.
JOEL
You didn't kill our baby.
KELLY
You don't know that.
JOEL
Yes, I do. I know you took the sleeping pill. I found the
bottle that night. Not the next morning. And I was worried, because of what
happened last time, so I watched you. I wanted you to get a good night sleep,
so I just watched you.
KELLY
You were watching me?
JOEL
You were so beautiful. It was so good to see you sleep.
But I shouldn't have been watching you. I should've known better, Kelly,
because all that time that I was watching you, ten feet away, our little baby.
(He starts crying) I'm sorry, I'm so sorry. (They embrace.)
DR. HERSCH
There wasn't anything you could've done.
JOEL
There is something. I could've watched my daughter.
DR. HERSCH
You haven't read this. You should have. What was your
baby's name?
JOEL
Emma
KELLY
Emma
DR. HERSCH
Well, according to this, Emma had a brain aneurysm. It was
bound to go off then or in grade school, or as a young mother with three
children herself. There was nothing you could have done, even if she was in
your arms. Your little girl got dealt a bad card. So did you.
INT. RESTAURANT - DAY
Kelly and Joel are seated in a booth.
KELLY
Do you realize how long it's been since we've been out to
dinner, just the two of us?
JOEL
Yeah, but I couldn't taken you to someplace better, though.
This is where I get coffee.
KELLY
I don't care about the food. I just like being alone with
you. I'd like it if we saw more of Dr. Hersh, and not as a lawyer.
JOEL
Okay.
KELLY
And there's something I didn't tell you in there, that I
want you to hear.
JOEL
Okay.
KELLY
Thank you.
JOEL
For what?
KELLY
For saving my life.
They kiss.
